AN ACT

FOR

PREVENTING FRAUDS UPON CREDITORS BY SECRET BILLS OF SALE
OF PERSONAL CHATTELS.

W

HEREAS frauds are frequently committed upon creditors by secret bills of sale of personal chattels, whereby persons are enabled to keep up the appearance of being in good circumstances and possessed of property, and the grantees or holders of such bills of sale have the power of taking possession of the property of such persons, to the exclusion of the rest of their creditors: for remedy whereof, be it therefore enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:

Court of

I. Every bill of sale of personal chattels made, after the passing Bills of Sale of of this Act, either absolutely or conditionally, or subject or not personal chattels, or subject to any trusts, and whereby the grantee or holder shall have copies thereof, with affidavit of power, either with or without notice, and either immediately the time of after the making of such bill of sale, or at any future time, to seize making thereof, &c., to be filed or take possession of any property and effects comprised in or made with officer of subject to such bill of sale, and every schedule or inventory which Queen's Bench shall be thereto annexed or therein referred to, or a true copy within twentyone days, otherthereof, and of every attestation of the execution thereof, shall, wise the same shall be void together with an affidavit of the time of such bill of sale being made as against or given, and a description of the residence and occupation of the assignees in bankruptcy, person making or giving the same, or, in case the same shall be &c., and made or given by any person under or in the execution of any seizing in process, then a description of the residence and occupation of the execution any property comperson against whom such process shall have issued, and of every prised in any such bill, so attesting witness to such bill of sale, be filed with the officer acting far as regards as clerk of the docquets and Judgments in the Court of Queen's any such property left in the Bench, within twenty-one days after the making or giving of such possession of the person bill of sale (in like manner as a warrant of attorney in any personal making the action given by a trader is now by law required to be filed), otherwise bill. such bill of sale shall, as against all assignees of the estate and effects of the person whose goods or any of them are comprised in

sheriffs, &c.,
