An Act to amend the "Ditches and Water-courses 1907, c. 14. Act, 1907."

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1. This Act may be cited as the "Ditches and Water-courses Act, Short title. 1907, Amendment Act, 1909."

2. Section 5 of chapter 14 of the Statutes of 1907, being the Amends s. 5. "Ditches and Water-courses Act, 1907, is hereby amended by inserting after sub-section (1) thereof the following sub-section :

"(1a.) In case the engineer appointed under this section is Substitute
unable to act on account of absence, sickness, or disability,
it shall be the duty of the Municipality to appoint a sub-
stitute engineer (who shall have all the power and
authority and responsibility of the engineer), so that any
works undertaken under authority of this Act shall not
be unreasonably delayed."

3. Section 18 of said chapter 14 is hereby amended by inserting Amends s. 18. after sub-section (2) thereof the following sub-section :

"(2A.) In case of subdivision of any lands affected by the award Subsequent award

by an owner or by the Municipality, make a subsequent
award apportioning the liabilities imposed by the original
award amongst the owners of the subdivided lands."

Amends s. 30.

Letting work on non-compliance with award.

4. Section 30 of said chapter 14 is hereby amended by inserting after the word " ditch," in the second line thereof, the words "or any portion thereof."

IS MAJESTY, by and with the advice and consent of the
Legislative Assembly of the Province of British Columbia,

enacts as follows:

1. This Act may be cited as the " Municipal Elections Act Amend- Short title. ment Act, 1909."

2. Paragraph (a) of section 14 of chapter 14 of the Statutes of Amends s. 14. 1908, being the "Municipal Elections Act," is hereby amended by to be posted on 5th striking out the word "tenth," in the first line of said paragraph (a), and by substituting therefor the word "fifth."

Paragraph (b) of said section 14 is hereby amended by striking Amends s. 14 out the word "tenth" in the first line of said paragraph, and sub- City Court of Restituting therefor the word "fifth," and by striking out the words 10th December. 4. Sub-section 2 of section 37 of said chapter 14 is hereby amended Amends sub-sec. (2), by striking out all the words after the word "officers" in the third line thereof and inserting in lieu thereof the following:-" and Nomination. unless the candidate shall, on or before the hour of 2 p.m. of the day of nomination, furnish the Returning Officer with a statement in writing specifying the land or real property upon which he qualifies, his nomination shall be invalid and shall not be acted upon by the Returning Officer."

5. Form 2 of the schedule to chapter 14 is hereby amended by striking out the last section numbered 4 therein and substituting therefor the following:

"(4.) That I am exempt from payment of road tax as I am over sixty (60) years of age, or I am a member of
