THE BACON MARKETING SCHEME (AMENDMENT) ORDER, 1934, DATED JUNE 20, 1934, MADE BY THE MINISTER OF AGRICULTURE AND FISHERIES AND THE SECRETARY OF STATE FOR SCOTLAND UNDER SECTION 1 OF THE AGRICULTURAL MARKETING ACT, 1931 (21 & 22 GEO. 5. c. 42).

1934, No. 679.

The Minister of Agriculture and Fisheries and the Secretary of State for Scotland, acting in conjunction, in exercise of the powers vested in them under Section 1 of the Agricultural Marketing Act, 1931, hereby make the following Order :

1. The Amendments of the Bacon Marketing Scheme, 1933, (a) set forth in the Schedule hereto are hereby approved.

2. The said Amendments shall come into force on the twentyfirst day of June, 1934.

3. This Order may be cited as "The Bacon Marketing Scheme (Amendment) Order, 1934."

SCHEDULE.

AMENDMENTS OF THE BACON MARKETING SCHEME, 1933, MADE UNDER SUB-
SECTION (11) OF SECTION 1 AND PART II OF THE FIRST SCHEDULE TO THE
AGRICULTURAL MARKETING ACT, 1931 (21 & 22 GEO. 5. c. 42), AS
AMENDED BY THE THIRD SCHEDULE TO THE AGRICULTURAL MARKETING ACT,
1933 (23 & 24 GEO. 5. c. 31).

The Bacon Marketing Scheme, 1933, shall be amended as follows:-
After paragraph 43 insert new paragraphs as follows:-

"43A. The Board may, in any case where a loan or grant is proposed to be made to them, agree with the person proposing to make the loan or grant, as the case may be, and in the case of a loan, with any person proposing to guarantee the repayment thereof, that if the loan or grant is duly made or the guarantee duly given, the Board will apply the money obtained by them by means of the loan or grant subject to such conditions (including conditions as to the persons on whose advice the Board are to act in applying the said money) as may be specified in the agreement.

"43B. The Board shall carry into effect any agreement entered into by them pursuant to the preceding paragraph and where such an agreement specifies conditions requiring the Board to act on the advice of any specified persons the provisions of paragraphs 43 and 60 of this Scheme shall not apply in relation to anything done or omitted to be done by the Board in pursuance of the aforesaid agreement.

"43C. Subject to any obligation of the Board under any agreement made in pursuance of paragraph 43A, the Board may pay out of any loan or grant made to them compensation to registered producers in respect of any loss which in the opinion of the Board has been occasioned to them by the operation of this or any other Scheme administered under the Act."

At the end of paragraph 44 insert the following words:

Every registered producer shall in addition to the aforesaid contribution contribute to the fund such sum, not exceeding ten shillings, as may from time to time be prescribed by the Board in respect of every pig purchased by him from the Pigs Marketing Board or pursuant to a contract prescribed by the Pigs Marketing Board, and the amount of such contribution shall be a debt due by him to the Board, but such contribution shall not be payable by him except in respect of a pig purchased by him at a price from which the curer was by the terms of the contract entitled to deduct the amount of such contribution."

Leave out paragraph 59 and instead thereof insert the following new paragraph:

“59. Contributions under paragraph 7 of the Second Schedule to the Act shall be assessed proportionately to the quantity of bacon delivered by each contributor under contracts of sale within a period of twelve months before the revocation of the Scheme or, in a case where the Scheme has not been revoked, within a period of twelve months before the commencement of the winding-up, but in no circumstances shall the total liability of a contributor exceed sixpence per hundredweight on the bacon so delivered :

"Provided that no contribution shall in any case be payable in respect of bacon delivered before the 1st November, 1933.”

THE BACON MARKETING BOARD (CO-OPTED MEMBERS) ORDER, 1934, DATED JUNE 29, 1934, MADE BY THE MINISTER OF AGRICULTURE AND FISHERIES AND THE SECRETARY OF STATE FOR SCOTLAND UNDER SECTION 14 (2) OF THE AGRICULTURAL MARKETING ACT, 1933 (23 & 24 GEO. 5. c. 31).

The Minister of Agriculture and Fisheries and the Secretary of State for Scotland, acting in conjunction, by virtue and in exercise · of the powers vested in them under Section 14 (2) of the Agricultural Marketing Act, 1933, and after consultation with the Bacon Marketing Board, hereby make the following order :

1. The following amendments shall be made to the Bacon Marketing Scheme, 1933 (a) :

(1) Paragraph five shall be amended by the addition at the end thereof of the following words, that is to say

"and two persons co-opted to the Board by the elected members of the Board after consultation with the Market Supply Committee:

Provided that during the period of twelve months from the thirty-first day of March, 1934, the co-option of any particular person to the Board for the purposes of this paragraph shall be subject to the approval of the Minister."

(2) The following paragraph shall be inserted immediately after paragraph five :

"5A. The persons co-opted in accordance with the provisions of the foregoing paragraph shall hold office. for two years from the first day of July in the year in which they are co-opted:

Provided that such one of the two persons first coopted as the Board may determine shall hold office for one year only."

(3) Paragraph eight shall be amended by the addition at the end thereof of the following words, that is to say—

or for co-option in accordance with the provisions of paragraph five of this Scheme."

(4) The proviso to paragraph ten shall be amended by the substitution for the words "any such co-opted member" of the words "any member who is co-opted under this paragraph in the place of an elected member."

2. This Order may be cited as The Bacon Marketing Board (Coopted Members) Order, 1934.

Whereas the Minister of Agriculture and Fisheries laid before each House of Parliament a draft amendment of the Hops Marketing Scheme, 1932, (a) as set forth in the Schedule hereto :

And whereas the House of Lords resolved on the fifth day of July, 1934, and the House of Commons resolved on the twelfth day of July, 1934, that the said amendment should be approved:

Now therefore the Minister of Agriculture and Fisheries, as required by Section 1 of the Agricultural Marketing Act, 1931, hereby makes the following Order :

1. The said Amendment is hereby approved in terms of the said draft.

2. The said Amendment shall take effect from the fourteenth day of July, 1934.

3. This Order may be cited as "The Hops Marketing Scheme (Amendment) Order, 1934."

The Hops Marketing Scheme, 1932, shall be amended as follows:In paragraph 4, page 3, line 1 (of page): leave out "elected" and instead thereof insert "district or special ".

In paragraph 8, page 3, line 29: after "creditors" insert "or

(d) if the Board by resolution declare that he has been absent from six consecutive meetings of the Board without reasonable excuse; or (e) if he is convicted of an offence under sub-section (2) of Section seventeen of the Act."

In paragraph 9, page 3, line 30: after "If" insert "within the six months next following a general election of district members of the Board".

In paragraph 9, page 3, line 30: leave out " special or ".

In paragraph 9, page 3, line 31: leave out special member or ".

In paragraph 9, page 3, lines 31 and 32: leave out "as the case may be ". In paragraph 9, page 3, line 32: after "place" insert

"If more than six months after the last general election of district members of the Board, a district member of the Board dies or vacates his office, then, if the Board so decide, another district member for the district in question shall be elected in his place, or the Board may, if they think fit, either co-opt a person to be the district member for the district in his place, or resolve that the vacancy shall not be filled till the next general election of district members.

If a special member of the Board dies or vacates his office, the Board may either co-opt a person to be a special member in his place, or, may resolve that the vacancy shall not be filled till the next general election of special members."

After paragraph 10, page 3, insert new paragraph as follows: :

"10A. The Board shall elect from among their members a Chairman and a Vice-Chairman, each of whom shall (provided that he remains a member of the Board) hold office until after the next general election of special members of the Board. At every meeting of the Board and at General meetings of registered producers, the Chair shall be taken by the Chairman, or, in his absence, the Vice-Chairman. If at any meeting neither the Chairman nor the Vice-Chairman is present, the meeting shall elect a temporary Chairman."

In paragraph 14, page 4, line 12: leave out "applied" and instead thereof insert "affixed."

In paragraph 14, page 4, line 13: leave out "at a meeting" and instead thereof insert "by the authority of a resolution ".

In paragraph 14, page 4, line 13: leave out" its application" and instead thereof insert "the affixing thereof ".

In paragraph 14, page 4, line 14: leave out "member acting as ".

In paragraph 14, page 4, line 14: after "Chairman" insert "or ViceChairman".
