To provide for the Enactment of certain Laws in the Island of Jamaica.

HEREAS the altered state of Society consequent on the total abolition by Law of Slavery in the Island of Jamaica, requires the enactment of further Laws to take effect within the said Island:

And whereas the House of General Assembly of the said Island, by an Address to the Governor thereof, on the Thirtieth day of October One thousand eight hundred and Thirty-eight, stated, that, for the reasons therein set forth, they had come to the determination to abstain from the exercise of any Legislative functions, except such as might be necessary to preserve inviolate the faith of the public Creditor:

And whereas the Legislature of the said Island having been prorogued, did subsequently meet on the Third day of November One thousand eight hundred and Thirty-eight, when the House of General 15 Assembly declared their adherence to such their former determination.

And whereas the House of Assembly of the said Island having been dissolved, the Legislature thereof did subsequently meet on the Eighteenth day of December One thousand eight hundred and Thirty20 eight, when the newly-elected House of General Assembly declared their adherence to the determination aforesaid of the preceding House of General Assembly:

And whereas, in consequence of the determination aforesaid, several temporary Laws of the said Island have been suffered to expire, some of which ought without delay to be revived or re-enacted :

And whereas, in consequence of the total abolition of Slavery in the Colonies next hereinafter mentioned, Her Majesty, by and with the 5 advice of Her Privy Council, did, on the Seventh day of September One thousand eight hundred and Thirty-eight, and on the Sixth day of October One thousand eight hundred and Thirty-eight respectively, make three several Orders in Council for the regulation, within the Colonies of British Guiana, Trinidad, Saint Lucia and Mauritius, of 10 Contracts for hired service in Agriculture or Manufactures, for the prevention of Vagrancy, and for the prevention of the illegal occupation of Lands within the said Colonies, and Laws to a similar effect are urgently required within the said Island of Jamaica:

And whereas it is necessary that provision should be made by Parliament for the purposes aforesaid in the event of the continued refusal or cessation of the House of Assembly of the said Island to exercise its legislative functions;

Be it therefore Cnacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spi- 20 ritual and Temporal, and Commons, in this present Parliament Governor and assembled, and by the Authority of the same, THAT from and after the First day of October One thousand eight hundred and Thirtynine, it shall be lawful for the Governor of the said Island of Jamaica, with the advice and consent of the Council thereof, to make Laws or 25 Ordinances for such of the purposes hereinafter mentioned, that is to say, the regulation of Contracts for hired service in Agriculture or Manufactures, the prevention of Vagrancy, and the prevention of the illegal occupation of Lands, as shall not previously to the making of such Law or Ordinance have been provided for by any Act or Acts 30 hereafter to be made by the Governor, Council and Assembly of the said Island; and every such Ordinance so to be made as aforesaid shall within the said Island of Jamaica and its Dependencies have the force and authority of law, any law, statute or usage to the contrary notwithstanding: Provided always, That the Ordinances so to be made for the purposes aforesaid shall, according to their respective subject-matter, be in conformity with the hereinbefore recited Orders of Her Majesty in Council, so far as it may appear to the said Governor and Council that the local circumstances of the said Island of Jamaica render the application to the said Island of the provisions of the said 40 Orders in Council, practicable and expedient: Provided also, That no such Ordinance shall impose any Rate, Tax or Duty, save only in so far as it may be necessary to impose any fine or forfeiture to enforce

the observance, or as a penalty for the non-observance of the provi-
sions of any such Ordinance.

And be it Enacted, That it shall be lawful for the said Governor, with the advice and consent of such Council, by any Law or Ordinance to be made by them for that purpose, to revive and continue in force, or to re-enact all or any of the Laws of the said Island which shall have expired since the Thirtieth day of October One thousand eight hundred and Thirty-eight, and which shall not have been since revived or continued in force, or re-enacted by any Acts or Act of the Governor, Council and Assembly of the said Island; and every such Law when so revived or re-enacted as aforesaid, shall have the same force and authority as if the same had been continued, revived or reenacted by an Act of the Governor, Council and Assembly of this said Island: Provided always, That no such expired Laws shall by 15 any such Ordinance as aforesaid be continued in force beyond the Thirty-first day of December One thousand eight hundred and Forty: Provided also, That it shall be lawful for Her Majesty, with the advice of Her Privy Council, to disallow any Ordinance so to be made for any of the purposes aforesaid, in such and the same manner as Her 20 Majesty in Council may disallow any act of the Governor, Council and Assembly of the said island: Provided also, That a Copy of every Ordinance which shall be made in pursuance of this Act, shall be laid before both Houses of Parliament.

And be it Enacted, That it shall be lawful for the Govenor, 25 Council and Assembly of the said Island, by any Act to be passed for that purpose, to repeal or alter any Ordinance which shall be made in

pursuance of this Act.

And be it Declared and Enacted, That, for the purposes and within the meaning of this Act, the Officer for the time being administering 30 the Government of Jamaica, shall be deemed and taken to be the Governor thereof.

And be it Enacted, That this Act may be amended or repealed by Act may be any Act to be passed during the present Session of Parliament,

Grand Jury Cess in certain cases in Ireland.

Recital of 6 & 7 W. 4,

HERCAS an Act was made in the Session of Parliament Preamble: held in the sixth and seventh years of the reign of his late Majesty King WILLIAM the Fourth, intituled, "An Act c. 110, s. 151. to consolidate and amend the Laws relating to the Presentment of Public Money by Grand Juries in Ireland:"

And whereas by said Act provision is made for the choosing of applotters by the landholders and inhabitants of the manor, parish or other denomination of land contained in the Treasurer's Warrant for the applotting the Grand Jury Cess to be levied thereon; and by said Act it is enacted, that "the persons so chosen shall, within Thirty Days from the time they shall be so chosen, applot the sum so to be levied upon such manor, parish or denomination, fairly and justly, according to the relative annual value of the several subdivisions of the lands and tenements therein contained, 15 stating, as accurately as they can, the name of the occupier of each portion of such lands, and shall make Oath, before any Justice of the Peace for such county, that they have made the said applotment justly, according to the best of their skill, without favour, affection or malice, the Jurat of which Oath shall be endorsed on the applotment; and such applotters shall deliver such applotment, so verified upon Oath, to the person empowered to collect such
