CHAPTER XXXVII.

An Act to amend an act for the benefit of John H. Carmichael and Benjamin Rains.

Be it enacted by the General Assembly of the State of Tennessee, That the further time of twelve months, from and after the first day of January, 1846, be allowed to John H. Carmichael and Benjamin Rains to complete their turnpike road, granted by the act of 1841, chap. 145, sec. 8.

CHAPTER XXXVIII.

An Act for the benefit of persons who may find or discover any mine or valuable minerals.

Be it enacted by the General Assembly of the State of Tennessee, That if any person or persons has heretofore found, or may hereafter find or discover any mine or valuable minerals on any vacant and unappropriated land, north and east of the Congressional Reservation line, such person, so finding or discovering such mine or valuable minerals, shall have a preference or priority of entry of the land on which said mine or valuable minerals may be situated for the space of six months from the finding or discovering of such mine or valuable minerals, before which time it shall not be lawful for any other person to enter said land. And it shall not be lawful for any other person to enter such land, until such person shall have given, in writing, at least thirty days previous notice to the person so having found or discovered such mine or valuable minerals, where the finder is known to him, of his intention to enter the same, and any entry made, grant obtained, contrary to the provisions of this act, shall be utterly void in law and equity.

CHAPTER XXXIX.

An Act to authorize the Circuit Courts to be held at other places than the Court
House in certain cases.

SECTION 1. Be it enacted by the General Assembly of the May hold in State of Tennessee, That if it shall so happen, that there is private house. no court house, or the court house is unfinished or out of repair, or from any cause is unsuitable to hold court in, in any County in this State, it shall be lawful for the circuit courts in such county or counties, by order of the circuit judge, to be holden in any house in the county town of such county, with all the powers they would have at the court house.

SEC. 2. Be it enacted, That the courts in the eighth judi- Eighth Circuit. cial circuit shall hereafter be held as follows, to wit:

In the county of Lewis, on the third Mondays in March, July and November.

In the county of Hickman, on the fourth Mondays in March, July and November.

In the county of Giles, on the first Mondays in April, August and December.

In the county of Marshall, on the third Mondays of April, August and December. And,

In the county of Maury, on the first Mondays in January and May, and the fourth Mondays in August, in each and

every year.

SEC. 3. Be it enacted, That the next terms of said courts when changed. be held under the law as it existed at the commencement of this General Assembly and afterwards, according to the provisions of this law, and all recognizances shall be taken, and all process of every kind whatever shall be issued and returned accordingly.

SEC. 4. Be it enacted, That all laws passed by the pre- Repeal.

provisions of this act, be and the same are hereby re-
pealed.

CHAPTER XL.

An Act to repeal the first section of an act passed the 30th of January, 1844, to establish a Chancery Court at Athens, McMinn county.

Be it enacted by the General Assembly of the State of Tennessee, That the first section of an act to establish a chancery court at Athens, McMinn county, and for other purposes, passed 30th January, 1844, chapter two hundred and one, be and the same is hereby repealed; that the bills now on file in the said chancery court at Athens, and all the papers belonging to the same, be removed to the chancery courts in which the same were, allowed to be filed before the passage of the act, the first section of which this is intended to repeal; and the books and papers belonging to said chancery court, shall be transferred as provided for in this act, under the directions of the Chancellor for the Eastern Division of Tennessee. The chancery court for Gibson county, shall hereafter be holden at Trenton, on the fourth Mondays in January and July, in each year.

CHAPTER XLI.

An Act to amend the Charter of the White's Creek Turnpike Company,

SECTION 1. Be it enacted by the General Assembly of the Branch road State of Tennessee, That the White's Creek Turnpike Com.pany be and the same is hereby authorized to construct and make a branch or arm of their said road, from the north end of their stone bridge, near where recently stood the Unity meeting house, upon such suitable ground as can be obtained, passing the White's Creek Springs to the top of the Ridge north of said Springs.

SEC. 2. Said road shall be graded twenty-one feet wide, and covered with gravel or broken rock to the width of eighteen feet, having a grade not exceeding three degrees, except at the Ridge, and there not exceeding six..

SEC. 3. Said company shall be authorized to erect one toll gate upon said branch, when the same shall be finished, and to charge the same rates of toll as are authorized in the original charter.

SEC. 4. That if any person shall forcibly or secretly pass the toll gate or gates of said company without paying

toll, or go round said gates to avoid payment of toll, such person, so offending, shall forfeit and pay five dollars for every such offence to said company to be recovered by action of debt before any justice of the peace in this State.

SEC. 5. That books of subscription shall be opened, after thirty days publication in one of the newspapers of the city of Nashville, under the superintendence of the Directors of the White's Creek Turnpike. And the said company shall not subscribe for more than one-half of the stock for said branch on the first, allowing the citizens living upon said creek, near the route of said proposed branch, the privilege of subscribing upon that day for one-half, and to be entitled to rateable proportion of the tolls received upon said branch.

CHAPTER XLII.

An Act to incorporate Bledsoe Female Academy, in the County of Sumner.

SECTION 1. Be it enacted by the General Assembly of the State of Tennessee, That A. R. Wynn, H. Bate, J. Patterson, Gen. William Hall and J. Belote, be and they are hereby constituted a body corporate by the name of the Trustees of Bledsoe Female Academy, situated in the county of Sumner, and shall have perpetual succession, and be capable in law to purchase, receive and hold to themselves and their successors, any lands, tenements, goods or chattels, which may be given, granted or devised to them, or purchased for the use and benefit of said Institution, and to appropriate and dispose of the same in such manner as to them may seem fit and proper for the use and benefit of said Academy. And the said Trustees and their successors, by the name aforesaid, may sue and be sued, plead and be impleaded in any court of law or equity in this State or elsewhere.

SEC. 2. Be it enacted, That the Trustees aforesaid, and Election. their successors, shall have power to hold such meetings, at such time and place as they may think proper, to elect one of their number President, and a Secretary and Treasurer of said board, and to fill all vacancies that may happen by death, resignation or otherwise.

SEC. 3. Be it enacted, That a majority of said Board of Power of Trus Trustees shall constitute a quorum to transact business relat

ing to the interest of said Academy. And said Board of Trustees shall have power to make such by-laws and regulations relative to said Academy. Provided, That they are not inconsistent with the constitution and laws of the State of Tennessee.

CHAPTER XLIII.

An Act to change the time of holding the General Musters in the 14th Brigade,
Tennessee Militia.

SECTION 1. Be it enacted, by the General Assembly of the Places of Muster. State of Tennessee, That the general musters in said brigade be holden at the following times and places:-At Frazier's in Sumner county, on the 3d Thursday in October in each and every year; at Bledsoe's Lick on the following day, Friday; and at Meadow's Tan-yard on the following day, Saturday; and at Walton's in Robertson county, on the following Monday; and at Ellis's in said county of Robertson on the following day, Tuesday; Provided, the places of holding said musters may be changed as they now by law can or may be changed.

SEC. 2. This act to take effect from and after the thereof.

SEC. 3. Be it enacted, That the regimental musters in the Musters in 17th 17th Brigade, shall be held as follows:-for the county of

Hickman, on the first Friday and Saturday after the first Monday in October; for the county of Wayne, on the next Tuesday and Wednesday; for the county of Hardin, on the next Friday and Saturday; for the county of Lawrence, on the next Tuesday and Wednesday. That the regiment first in number shall muster first.
