Judges EUSTIS and RosT, resigned their commissions on the last of May and June, 1839.

On the 31st August, 1839, GEORGE STRAWBRIDGE and ALONZO MORPHY, ESQS., were appointed and commissioned by the Governor to fill the vacant seats. After his return from the Western District, Judge Strawbridge resigned his commission; and on the return of Judge Eustis from France, the beginning of December following, a new commission was sent to him by the Governor, which he declined accepting.

During the session of the Legislature in the Winter of 1840, the Governor nominated to the Senate, Messrs. Bullard, Morphy, Simon and Garland, to fill the existing vacancies, and to increase the Supreme Bench to the number five, authorized and required by law. The nominations were all confirmed by the Senate.

The Supreme Court is now composed of the following members:
