EAST INDIA HOUSE, 11th August, 1802.

TERMS and CONDITIONS, under which the East India Company are willing to furnish Tonnage, exclusive of (3000 Tons) that to be provided by the Act of the 33d of his present Majesty, Chap. 52.

I That every Application do specify the respective Tonnage of measurable and heavy Goods, the particular articles of which each species of Tonnage consist, the Places to which they are to be consigned, and the Periods when the same will be ready to be shipped.

II. That the Court, in order to encourage the Export of a sufficient Supply of necessary Articles for Consumption in India, do not intend to restrain the Exportation wholly to the Letter of the Act, which limits the articles to such as are of the Growth, Produce, or Manufacture of Great Britain, though the Court reserve to themselves the Power of limiting the Exportation of those Articles which are not of the Produce of Great Britain, or the Exportation of which, by Individuals, is not permitted by the Act, to such Quantities as may not be injurious to the Sale of the Company's Exports.

III. That the Rate of Freight for Goods from England to India be at a Rate not exceeding

per Ton. IV. That the Rate of Freight Homeward, on the Ships of this Season, shall not exceed per Ton, for the Extra Ships already engaged.

V. That Wine freighted from Madeira to India, in such of the Company's extra Ships which the Court may find it requisite should touch there, be at the Rate of Four Pounds per Pipe, and that Persons requiring Tonnage for wine from Madeira shall be at liberty to lade in Articles for that Island, Freight free, to the Amount of the Tonnage they may be allowed in Wine from thence to India.

VI. That every person do make a Deposit in the Company's Treasury, within Fifteen Days after their Request to ship Goods shall have been granted by the Court, of the Amount of Freight chargeable on such Goods, at the rate above-mentioned, under the Regulations of the Act.

VII. That the Court do reserve to themselves the Right of allotting to any of the Ships in their service bound to the res

pective Places of Consignment, the Goods in such Proportions as they may think proper; at the same Time, the Court will endeavour to comply, as far as Circumstances will admit, with the particular Wishes of the Proprietors, respecting the shipping of their Goods..

VIII. That should the Produce of such Goods, or Wine, be paid into the Company's Treasury at either of the Three Presidencies, or Bencoolen, Bills will be granted on the Court of Directors, on the terms of the Season to other Individuals.

IX. The Proprietors of Goods shall be exactly on a similar Footing with the Company, in Respect to short Delivery, as is contained in the Terms and Conditions under which the Ships have been engaged.

X. That each Shipper of Goods, jointly with the Company, shall be entitled to all Allowances for Ship Damage and short Delivery, not exceeding Four Pounds per Ton on their res pective Tonnage, that is to say, Four Pounds per Ton to such Persons who occupy the like Proportion of Tonnage Outand Home, whether the Damage be in the Outward or Homeward Goods, and Two Pounds per Ton on the Outward Goods, and the like Sum on the Homeward Goods, when they belong to different Proprietors, averaging on the whole at the Rate of Five Pounds per Ton, on the Builder's Measurement, agreeably to the Forty-fourth Clause of the Terms under which the Ships have been engaged.

XI. That in all other Cases, the Owners of Goods will be subject to the same Decisions and Determinations only, as the Company themselves are liable to.

Regulations respecting Private Trade,

That all Orders issued for the Shipping of Goods on Freight, from the Office of Private Trade, Outwards, be Countersigned, in the Accountants Office; and certified that the Freight of the goods contained in such orders has been duly paid; the Company's Husband not to Ship the goods unless the order be Countersigned and certified in the manner above directed.

That not any order be given by the Officer in the Private Trade department Outwards, for Goods allowed to be shipped on Freight; until the several persons who are permitted to export the same, shall have delivered into the Office an exact account of the Tonnage of each article, which they

If the Owners of the 1200, 800, and 600 Ton Ships should be desired by the Committee of Shipping to provide for a Number of Passengers, the undermentioned Quantities of Provisions and Stores are to be permitted to be received for the following Numbers of Persons, respectively, addition to the several Articles before-mentioned, and in the same Proportion for a greater or less Number, viz.
