CHAPTER 47

An Act respecting the Sale or Lease of Certain Lands belonging to His Majesty.

[Assented to January 11, 1913.]

IS Majesty by and with the advice and consent of the

1. This Act shall apply to the lands being the property of his Majesty set out in the schedule to this Act and to any other lands belonging to his Majesty which may from time to time be added to the said schedule by the Lieutenant Governor in Council.

2. Notwithstanding anything contained in The Land Titles Act the Lieutenant Governor in Council shall have power, in connection with the transfer or lease of any such lands or of any portion thereof, to provide that the transferee or lessee of the same, as the case may be, and his assigns shall hold the same subject to such conditions, restrictions and limitations and subject to the performance by the said transferee or lessee and his assigns of such covenants as may be provided by Order in Council.

3. Upon the granting of any such transfer or lease an Order in Council shall be passed setting out the conditions, restrictions, limitations and covenants which attach to the same and a copy of the said Order in Council shall be registered in the proper land titles office, and the conditions, restrictions, limitations and covenants set out in such Order in Council shall attach to the lands and shall be binding upon the transferee or lessee, as the case may be, his heirs and assigns and all persons acquiring any interest in the said land by way of incumbrance, lien or otherwise shall hold the said interest subject to the same.

4. The said lands shall while the title thereto remains in his Majesty be subject to such taxes as may be agreed upon by the Lieutenant Governor in Council with the municipality in which such land is situated.

5. Save as is herein provided the said lands shall be and remain subject to the provisions of The Land Titles Act.

SCHEDULE.

1. All that part of the north-west quarter of section number eighteen (18) in township number seventeen (17) and range number nineteen (19) west of the second meridian in the Province of Saskatchewan in the Dominion of Canada described as follows: Commencing at the south-west corner of the said quarter section, thence northerly along the west boundary of the said quarter section until it strikes the edge of the Regina reservoir as at present located, thence easterly and southerly following the sinuosities of the southern edge of the said reservoir as at present located until it strikes the line dividing the north-west quarter section from the south-west quarter section of the said section eighteen (18), thence westerly along the said dividing line to the place of beginning, containing fifteen acres more or less; secondly, all that portion of the fractional south-west quarter of section number eighteen (18) in township number seventeen (17) and range number nineteen (19) west of the second meridian in the Province of Saskatchewan and being a part of that part of the said quarter section lying south and west of the Regina reservoir, and which may be more particularly described as follows: commencing at the south-west corner of the said quarter section, thence easterly along the southern boundary thereof a distance of two thousand six hundred and twenty-two (2,622) feet, thence northerly and keeping parallel with the western boundary of the said quarter section a distance of five hundred and forty-four feet six inches (544 ft. 6 in.) more or less to the point where the said line so produced parallel to the western boundary as aforesaid intersects the southern edge of the Regina reservoir, thence westerly, north-westerly and northerly following the sinuosities of the said reservoir to a point where the southern edge of the said reservoir intersects the north boundary of the said quarter section, thence west and following the said north boundary a distance of nine hundred and eighty-three feet five inches (983 ft. 5 in.) more or less to the north-west corner of the said quarter section, thence southerly along the western boundary of the said quarter section a distance of twenty-six hundred and forty (2,640) feet more or less to the place of beginning, and containing ninety-six (96) acres, more or less; thirdly, that portion of the original road allowance adjoining the north boundary of the north-west quarter of section number seven (7) township number seventeen (17) range number nineteen (19) west of the second meridian in the Province of Saskatchewan and which may be more particularly described as follows: The most westerly twenty-six hundred and twenty-two (2,622) feet of said road allowance, being sixty-six (66) feet in width containing four (4) acres, more or less; fourthly, all that parcel or tract of land which may be more particularly described as follows: commencing at the north-west corner of section number seven (7) township number seventeen (17) range number

nineteen (19) west of the second meridian in the Province of Saskatchewan, thence easterly along the northern boundary of the said section a distance of two thousand six hundred and twenty-two (2,622) feet, thence south keeping parallel with the western boundary of the said quarter section a distance of eight hundred and seventy-four feet four inches (874 ft. 4 in.), thence westerly a distance of two thousand six hundred and twenty-two feet (2,622) more or less and keeping parallel with the northern boundary of the said quarter section to intersect the western boundary thereof at a point distant eight hundred and seventyfour feet four inches (874 ft. 4 in.) south from the north-west corner of the said quarter section, thence north and following the said western boundary a distance of eight hundred and seventy-four feet four inches more or less to the said north-west corner and containing fifty-three acres more or less.

2. All that portion of section 18 township 17 range 19 west of the second meridian which lies north of Wascana lake excepting that portion of the said section described in Certificate of Title No. 59 G.Q. which portion stands in the name of the city of Regina and is known as Wascana Park.

3. All that portion of the south half of section 19 township 17 range 19 west of the second meridian containing six and eighty-three hundredths (6.83) acres more or less and which is more particularly described as follows: Being bounded on the south by the south boundary of of the said section, on the north by the southern limit of Sixteenth avenue in the city of Regina as shown upon a plan of said city signed by L. A. Hamilton, Dominion land surveyor, on the sixteenth day of October, A.D. 1882, and on record in the land titles office for the Assiniboia land registration district as Old No. 33, on the west by the production southerly of the western limit of Cornwall street in the said city as shown upon the said plan of the said city and on the east by the eastern boundary of said section 19.
