Governor in Council shall proclaim the date of the coming into force of the said Act; otherwise the Act shall not be proclaimed and shall not come into force.

15. The Lieutenant Governor in Council may make regulations not inconsistent with this Act for the proper carrying out of its provisions and particularly for regulating the procedure prior to, at and after the said voting, the advertising of the taking of the said vote and such other matters as shall be deemed advisable.

CHAPTER 4

An Act to amend An Act respecting the Department of Railways, Telegraphs and Telephones.

[Assented to January 11, 1913.]

IS Majesty by and with the advice and consent of the Legislative Assembly of Saskatchewan enacts as follows:

1. The title to the said Act being chapter 13 of The Revised Statutes of Saskatchewan 1909 is amended by striking out the words "railways, telegraphs and" therein.

2. Section 1 of the said Act is amended by striking out the words "railway and" in the short title therein mentioned.

3. Clauses 1 and 2 of section 2 of the said Act are amended by striking out the words "railways, telegraphs and" whereever they occur in either of the said clauses.

(2) Clause 3 of said section 2 is repealed.

4. Section 3 of the said Act is amended by striking out the words "railways, telegraphs and" wherever they occur therein.

5. Section 7 of the said Act is amended by striking out the words "railway or any telegraph" where they occur therein.

6. Section 8 of the said Act is hereby repealed.

7. The said Act is hereby amended by adding thereto the following as section 26:

"26. When in any law in force in the province any duties, powers or acts have been assigned or intrusted to the minister of railways, telegraphs and telephones the Lieutenant Governor in Council shall from time to time determine which of the said duties, powers and acts shall be assigned and intrusted to the minister of telephones and the same shall thereupon be assigned to him, and such assignment shall have the same force and effect in all respects as if the minister of telephones had been named in such law in lieu of the minister of railways, telegraphs and telephones."

An Act respecting the Department of Railways.

1. This Act may be cited as "The Railway Department Act."

Interpretation 2. In this Act unless the context otherwise requires the "Railway" expression "railway" means any railway which by any special Act of the province any company, corporation or person is authorised to construct or operate and includes all branches, sidings, stations, shops, buildings, wharves, bridges, rolling stock, equipment, stores, property (real and personal) and works connected therewith, also any railway within the provisions of The Railway Act.

3. There shall be a department of the public service of the province to be called the department of railways, over which the member of the Executive Council appointed by the Lieutenant Governor under the seal of the province to discharge the functions of the minister of railways for the time being shall preside.

4. The minister may require any person having the session of any plans, maps, drawings, reports, papers, tracts, records, documents or other things relating to any railway system and not being the private property of such person to deliver the same without delay to the department under a penalty of $20 for each day's delay.

CHAPTER 6

An Act to amend The Treasury Department Act.

IS Majesty by and with the advice and consent of the
Legislative Assembly of Saskatchewan enacts as follows:

1. The Treasury Department Act is hereby amended by inserting therein the following as section 27a:

"27a. Notwithstanding anything herein contained respecting the collection of revenue and its deposit in the general revenue fund or the expenditure of public moneys and the accounting for such collection and expenditure by the provincial treasurer the Lieutenant Governor in Council may approve of any regulations which may be framed from time to time by the treasury board providing for dealing independently of the general revenue fund with moneys collected as revenue from telephone tolls, exchanges or other kindred services by the department of telephones and for making expenditures directly by the said department out of such revenue or out of such other moneys as may be appropriated by the Legislative Assembly for expenditure upon telephone services and for accounting for such collections and expenditures by the minister of telephones:

"Provided always that such collections and expenditures. shall be subject to audit by the provincial auditor in the same manner as this Act provides in respect of all other collections and expenditures of public moneys;

"Provided also that no expenditure of public moneys shall be made hereunder upon any service connected with the provincial telephone system unless and until such expenditure shall first have been authorised as expenditures of public moneys are required to be authorised by this Act;

"Provided further that from and after the adoption of any regulations hereunder and while such regulations remain in force and effect the minister of telephones shall furnish the provincial treasurer as soon after the close of each fiscal year as may be practicable with statements of the revenues collected and the expenditures made clearly and succinctly showing all financial transactions for the fiscal year connected with the provincial telephone system which statements shall be published with the public accounts."
