5. Any construction work heretofore done by the said applicants or on their behalf according to the map, plan or profile of the said railway or spur, which may be filed in the office of the Chairman of the Executive Council at the time of the coming into force of this Act shall be deemed and taken to have been properly done under the powers granted herein and the acquisition and use by the said company of the said railway or spur so constructed is hereby authorized, ratified and confirmed.

6. The persons mentioned by name in the first section of this Act are hereby constituted provisional directors of the said company.

7. The capital stock of the company shall be sixty thousand ($60,000.00) dollars and may be called up by the directors from time to time as they deem necessary, but no one call shall exceed ten per cent. on the amount subscribed.

8. The annual general meeting of the shareholders shall be held on the first Tuesday in February of each year, or at such time as the board of directors may determine.

9. At such meeting the subscribers for the capital stock assembled shall have paid all calls due on their shares, shall choose five persons to be the directors of the company, one or more of whom may be paid directors of the company.

10. The company may issue bonds, debentures or other securities to the extent of fifteen thousand ($15,000.00) dollars per mile of the railway and branches, and such bonds, debentures or other securities may be issued only in proportion to the length of railway constructed or under contract to be constructed.

11. The company may enter into an agreement with another company or companies for conveying or leasing to such company or companies the railway of the company hereby incorporated, in whole or in part, or any rights or powers acquired under this Act, as also the surveys, plans, works, plant, material, machinery and other property to it belonging, or for an amalgamation with such company or companies, on such terms and conditions as are agreed upon, and subject to such restrictions as to the directors seem fit; provided that such agreement has been first sanctioned by two-thirds of the votes at a special general meeting of the shareholders duly called for the purpose of considering the same, at which meeting shareholders

representing at least two-thirds in value of the stock are present in person or represented by proxy, and that such agreement has also received the approval of the Lieutenant Governor in Council.

12. The company agrees to afford all reasonable facilities to any other railway company for the receiving and forwarding and delivery of traffic upon and from the line of railway belonging to or worked by such companies respectively, and the company shall not make or give undue or unreasonable preference or advantage to or in favour of any particular person or company, or any particular description of traffic in any respect whatsoever, nor shall the company, subject any particular person or company, or any particular description of traffic, to any undue or unreasonable prejudice or disadvantage whatsoever, and the said company shall afford all due and reasonable facilities for receiving and forwarding by its railways all the traffic arriving by such other railway or railways without any unreasonable delay, and without any such preference or advantage or prejudice or disadvantage as aforesaid, so that no obstruction is presented to the public desirous of using such railway as a continuous line of communication, and so that all reasonable accommodation by means of the railways of the several companies is at all times afforded to the public in that behalf, and any agreement made between the company and any other company or companies contrary to this agreement shall be null and void.

13. The construction of the railway hereby authorized shall be commenced within two years and shall be completed within five years from the date of the coming into force of this Act.

14. The company shall also have power for the purposes of its undertaking to construct and operate an electric telegraph line or lines and a telephone line or lines along the said railway, and to construct and maintain such bridges as shall be necessary or convenient for the use of said railway, not being bridges over any navigable river or rivers, unless such bridge or bridges over such navigable rivers or waters has or have been authorized by the Governor General in Council.

15. This Act shall come into force on the day it is assented to.

CHAPTER 40.

An Act to amend the Act Incorporating the Canadian Northern Western Railway Company.

(Assented to March 25, 1913.)

WHEREAS the Canadian Northern Western Railway Company has presented a petition praying for the amendment of the Act incorporating the said company, being chapter 48 of the Statutes of Alberta, 1910 (Second Session), so as to empower the said company to construct and operate the lines of railway hereinafter set forth and it is expedient to grant the prayer of the said petition;

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

1. Section 8 of chapter 48 of the Statutes of Alberta, 1910 (Second Session), being an Act to incorporate the Canadian Northern Western Railway Company, is hereby amended by adding thereto the following subsection:

"(3) The company may also lay out, construct and operate the following lines of railway of the gauge of four (4) feet eight and one-half (82) inches, namely:

"1. From a point at Taber, thence in a generally northeasterly direction to a point at Consort.

"2. From a point at the City of Medicine Hat, thence in a generally north-westerly direction to a point on the Saskatoon-Calgary line of the Canadian Northern Railway Company.

"3. From a point on the Saskatoon-Calgary line of the Canadian Northern Railway Company in or near ranges twelve (12) to fourteen (14) west of the fourth meridian; thence in a generally northerly direction to a point on the main line of the Canadian Northern Railway Company in or near ranges six (6) to nine (9) west of the fourth meridian.

"4. From a point on the Saskatoon-Calgary line of the Canadian Northern Railway Company in or near ranges twelve (12) or thirteen (13) west of the fourth meridian; thence in a generally north-easterly direction to the eastern boundary of the province.

"5. From a point at Cardston; thence in a generally westerly direction to the western boundary of the province.

"6. From a point at or near Meeting Creek on the Vegreville-Calgary branch of the Canadian Northern Railway to a point at the City of Wetaskiwin, and thence west by Pigeon Lake to a point on the Strathcona-Pincher Creek line of this railway.

"7. From a point at Drumheller on the VegrevilleCalgary branch of the Canadian Northern Railway to the Village of Carbon."

2. The construction of the lines of railway hereby authorized shall be commenced within one year, and construction amounting to not less in mileage than two hundred miles of completed road of the lines herein above referred to taken together with the lines of railway mentioned in the Act to amend the Act incorporating the said railway, being chapter 29 of the Statutes of Alberta, 1911-12, shall be done in each year, and the lines of railway in the last preceding section hereof shall be completed within five years from the date of the coming into force of this amending Act.

CHAPTER 41.

An Act to Incorporate the Brule Lake Railway Company.

(Assented to March 25, 1913.)

WHEREAS a petition has been presented praying for the incorporation of a company to construct and operate a railway, as hereinafter set forth, and it is expedient to grant the prayer of the said petition;

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

1. George Goldwin Smith Lindsey, K.C., Toronto, Ontario; Sydney Brown Woods, K.C., Edmonton, Alberta; Oliver Mowatt Biggar, barrister, Edmonton; Sem W. Field, barrister, Edmonton; James Thomas Joseph Collisson, barrister, Edmonton, together with such persons as become shareholders in the company hereby incorporated, are hereby constituted a body corporate under the name of "The Brule Lake Railway Company," hereinafter called "the company."

2. The head office of the company shall be in Edmonton in the Province of Alberta.

3. The several clauses of The Railway Act of Alberta shall be, and the same are hereby, incorporated with and shall be deemed to be part of this Act, and shall apply to the said company and to the railway to be constructed by them, excepting so far as the same may be inconsistent with the express enactments hereof, and the expression "this Act" when used herein shall be understood to include the clauses of the said Railway Act as aforesaid.

4. The company may lay out, construct and operate by steam or electric power a railway of standard gauge, 4 feet 82 inches, commencing at a point at or near to mile 994 on the Grand Trunk Pacific Railway west of Winnipeg, being a point on the east shore of Brule Lake in the Province of Alberta, thence in a south-easterly direction through sections 26 and 24, township 49, range 27, west of the
