WE resume the subject of the diplomatic correspondence relative to the case of The Trent. Having in our last number (supra, p. 19) considered the first proposition of the American Minister, "Were the persons named, and their supposed despatches, contraband of war?" we now proceed to the others.

The second is, "Might Captain Wilkes lawfully stop and search The Trent for these contraband persons and despatches?" This point the American Minister resolves in the affirmative. He says:"Whatever disputes have existed concerning a right of visitation or search in time of peace, none, it is supposed, has existed in modern times about the right of a belligerent in time of war to capture contraband in neutral and even friendly merchant vessels, and of the right of visitation and search, in order to determine whether they are neutral, and are documented as such according to the law of nations."

similar doctrine is laid down by Wheaton in his Ele-
ments of International Law, 587, 588, 6th ed.

Some modern writers have sought to draw a distinction in favour of vessels employed on services like that of The Trent. In the 6th edition of Wheaton's Elements of International Law, by Lawrence, 1855, p. 567, note (a)) we find this passage:

"It is conceived that the carrying of despatches can only invest a neutral vessel with a hostile character in the case of its being employed for that purpose by the belligerent, and that it cannot affect with criminality either a regular postal packet or a merchant ship which takes a despatch in its ordinary course of conveying letters, and with the contents of which the master must necessarily be ignorant. . . . . Since the former European wars some Governments have established regular postal packets, whose mails, by inter

Adm. 340):-" The right of visiting and searching merchant ships upon the high seas, whatever be the ship, whatever be the cargo, whatever be the destination, is an incontestable right of the lawfully-national conventions, are distributed throughout the commissioned cruisers of a belligerent nation. I say, be the ship, the cargoes, and the destinations what they may; because, until they are visited and searched, it does not appear what the ships, or the cargoes, or the destinations are; and it is for the purpose of ascer
