CHAPTER 40

An Act to amend The Crop Payments Act.

[Assented to March 1, 1927.]

IS Majesty, by and with the advice and consent of

as follows:

1. Section 2 of The Crop Payments Act is amended by Rev. Stat. adding thereto the following subsection:

"(2) The word 'lease' in this Act shall include any agreement whereby a mortgagor agrees to become the tenant of a second or subsequent mortgagee only when no agreement has been made with a prior mortgagee and the first mortgagee, or all the prior mortgagees, if there are more than one, have consented thereto in writing."

2. This Act shall come into force on the first day of Coming into May, 1927.

CHAPTER 41

An Act to amend The Game Act, 1924.

[Assented to March 3, 1927.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts. as follows:

1. The Game Act, 1924, is amended in the manner hereinafter set forth.

2. Section 2 is amended by adding thereto the following paragraph:

"18. 'Private game or fur farm' means a parcel of land either leasehold or freehold upon which the owner or occupant has received a permit from the minister to engage in the breeding or propagating for commercial purposes of specified game birds, big game animals or fur bearing animals."

3. Subsection (2) of section 4 is repealed and the following substituted therefor:

"(2) In no case shall any person kill more than two big game animals in all, of which not more than one shall be moose, in one season."

4.-(1) Clause (c) of section 7 is repealed and the following substituted therefor:

"(c) any bird of the family Rallidae, commonly

known as coots, between the first day of January and the fifteenth day of September, nor shall more than twenty-five of these birds be killed. by one person in any one day nor more than one hundred and fifty in any one season, and no other species of this family including rails. and gallinules shall be taken at any time." (2) Clause (d) of the said section 7, as enacted by chapter 36 of the statutes of 1925-26, is amended by striking out the words "black-breasted and golden plover" in the second and third lines and by striking out the word "snipe" in the tenth line and substituting therefor the words "black-breasted and golden plover;".

(3) Clause (f) of the said section 7 is repealed and the following substituted therefor:

"(f) any bird of the family Phasianidae, commonly
known as European Grey or Hungarian part-
ridge, between the first day of November in
any year and the first day of October of the
following year, nor shall more than ten in all
of these birds be killed by one person in any
one day, nor more than thirty in all in one

season.

5. Subsection (2) of section 10 is repealed and the Section 10 following substituted therefor:

"(2) Any person using for the hunting or taking of game birds any of the contrivances or guns mentioned in clause (b) of subsection (1) shall be guilty of an offence and liable on summary conviction to a penalty of not less than $10 nor more than $100, together with costs, and in default of payment to imprisonment for a term not exceeding six months, and such contrivance or gun shall be forfeited to His Majesty in the right of Saskatchewan."

6. Clause (d) of subsection (1) of section 11 is re- Section 11 pealed and the following substituted therefor:

"(d) beaver before the thirty-first day of December,

1930, without permission from the minister."

7. Section 12 is amended by striking out all the words Section 12 after the word "muskrats" in the fifth line and substituting the words: "under regulations to be made by him."

8. The following is inserted after section 15:

"15a. No person shall set, lay, prepare or have in Snares prohis possession any snare for the purpose of catching, taking or killing wolves, coyotes or foxes."

9. Subsection (2) of section 18 is amended by striking Section 18 out the word "or" where it first occurs in the second line and substituting the words "one dozen."

10. The following section is inserted after section 29: New section

29a

Dominion

"29a. The Lieutenant Governor in Council may Power to lease authorise the minister to enter into an agreement with lands the Dominion government for the lease of any Dominion lands and water areas in the province, for the propagation of fur bearing animals, and to sublet such areas to approved applicants under regulations of the Lieutenant Governor in Council."

New section 30

Private game o: fur farms

11. Section 30 is repealed and the following substituted therefor:

"30.-(1) Notwithstanding anything in this Act, any person desiring to engage in the business of breeding game or fur bearing animals may make application in writing to the minister in the form prescribed by him, for a permit to do so.

"(2) The minister when satisfied that the application is in the interests of game preservation may, upon receipt of an annual fee of $5, grant a permit to any person permitting the holder thereof, upon a specified area of land, occupied by him either as owner, lessee or tenant, to breed or keep for propagating or commercial purposes any species of game or any of the fur bearing animals mentioned in schedule C, and such area of land shall be known as a private game or fur farm.

"(3) Any person holding such a permit shall annually on or before the first day of January make application for renewal thereof to the Game Commissioner, Department of Agriculture, Regina, and shall forward with the application a report giving such details of the year's operations as may be required.

"(4) The holder of such permit may sell and ship for propagating purposes any of the game or fur bearing animals bred on such farm, upon showing to the express agent his fur farm permit for the current year.

"(5) The holder of a fur farm permit may pelt any fur bearing animal in his possession during the lawful open season for trapping such animals.

"(6) Fur royalty fees shall not be payable upon skins or pelts of fur bearing animals, other than muskrats, bred under authority of this section, but a permit shall be obtained to sell within or ship out of the province such pelts as are exempt from royalty, the fee for which shall be $1 for each shipment.

"(7) A permit shall accompany each parcel of furs sold within the province and shall be indorsed by each person disposing of the pelts covered by the permit; and when such pelts are offered for export the permit shall be presented to the postmaster or express agent, as the case may be, who shall immediately upon accepting the furs forward the permit to the Game Commissioner.

"(8) Applications for such permits shall show the number and date of the applicant's fur farm permit, names and addresses of the consignee and consignor, and the number and kind of pelts to be disposed of or exported.

"(9) Failure to comply with subsections (6), (7) and (8) shall render all such pelts subject to royalty payment.

"(10) Every game guardian shall have access at all reasonable times to inspect any game or fur farm for the purpose of investigating the work and ascertaining the progress made.

"(11) The provisions of The Animals Protection Act, chapter 168 of The Revised Statutes of Saskatchewan, 1920, shall apply, mutatis mutandis, to game or fur bearing animals kept for breng purposes upon any private game or fur farm.

"(12) Wherever in this section the term 'game' is used it shall mean only such animals and birds as are mentioned in sections 4 and 7 of this Act, and wherever the term 'fur bearing animals' is used it shall mean only such animals as are mentioned in schedule C."

12. Subsection (1) of section 33 is amended by striking Section 33 out the words "of the fur bearing animals mentioned in section 11" in the second and third lines, and substituting the words "fur bearing animals, other than rabbit," and by adding thereto the following proviso:

"Provided that nothing in this section shall apply to any person destroying any predatory for bearing animal, in defence or preservation of property upon premises owned or occupied by him.'

13. Section 35 is amended by striking out the words Section 35 "protected by this Act" in the third line thereof.

14. Subsection (1) of section 37 is amended by striking Section 37 out the expression "$10" in the last line and substituting amended "$1."

15. Subsection (3) of section 38 is repealed and the Section 38 following substituted therefor:

"(3) The fee to be paid therefor shall be, in the case of persons domiciled in the Dominion of Canada, $25 for a license to trap fur bearing animals, $25 for a big game license, and $10 for a game bird license; and the fee in all other cases shall be $50 for a license to trap fur bearing animals, $50 for a big game license and $25 for a game bird license."

16. Subsection (1) of section 55 is amended by striking Section 55 out the word "preserves" in the sixth line and substituting the words "or fur farms."

17. Section 61 is amended by inserting after the word Section 61 "hunting" in the sixth line the following:

"except such contrivances or guns as are referred to

in clause (b) of subsection (1) of section 10."
