CHAPTER 75

An Act to provide Exemption from Taxation upon
Certain Lands to Les Reverends Peres Oblats
de Marie Immaculee des Territoires du Nord-
Ouest.

[Assented to February 7, 1927.]

HEREAS Les Reverends Peres Oblats de Marie Immaculee des Territoires du Nord-Ouest was incorporated by an Act of the Parliament of Canada being chapter 96 of the statutes of 1883, with power, inter alia, to provide for schools and colleges; and

Whereas the said corporation has established an educational institution at Lebret, in the Province of Saskatchewan known as Scolasticat du Sacre Coeur; and

Whereas a petition has been presented by the said corporation praying for the exemption from taxation of certain lands; and

Whereas the Municipality of North Qu'Appelle No. 187, has by resolution, consented to such exemption; and Whereas it is expedient to grant the prayer of the said petitioner:

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. The real and personal property of the said corpora- Exemption tion, and the lands on which it is situated, namely, all taxation and singular that certain parcel or tract of land situate in the Province of Saskatchewan and being composed of the fractional south-east quarter of section three (3) township twenty-one (21) in range thirteen (13) west of the second meridian in the Province of Saskatchewan, containing one hundred and forty hundredths (100.40) acres more or less, shall, while used for religious and educational purposes, be exempt from all taxes, rates and levies and assessment of every nature and kind save and except special assessment taxes which may from time to time hereafter be levied by the municipality in which said property of the corporation is situated.

CHAPTER 76

An Act to amend An Ordinance to incorporate "The Yorkton Queen Victoria Cottage Hospital," being chapter 23 of the Ordinances of 1902.

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

New section 3 1. Section 3 of chapter 23 of the Ordinances of 1902, being An Ordinance to incorporate "The Yorkton Queen Victoria Cottage Hospital," is hereby repealed and the following section is substituted therefor:

"3. The affairs of the said corporation shall be managed by a board of directors consisting of eleven members of whom six constitute a quorum; and the said Thomas Meredith, William Rufus Parsons, Charles Wilford, Ralph Pearson, James Hartley Nelson and James Stewart Crerar shall constitute the first board of directors and shall hold office as such directors until their successors are appointed as hereinafter provided.'

New section 5 2. Section 5 of the said Ordinance is hereby repealed and the following section is substituted therefor:

Appointment of secretary treasurer, etc.

"5. The board of directors shall every year at their first meeting after election appoint a secretary and a treasurer or a secretary treasurer who may be one of their own number; and shall at such meeting appoint from among themselves a president and a vice president.

New section 7 3. Section 7 of the said Ordinance is hereby repealed and the following section is substituted therefor:

Director automatically ceasing to be such

"7. In the event of any director dying or resigning his office, or automatically ceasing to be a director by virtue of the provisions of any bylaws then in force before the expiration of his term, his successor shall be appointed by the board of directors to fill the vacancy until the next annual meeting; and at such annual meeting

a director shall be elected for the unexpired term of any such director who has died or resigned or who has ceased automatically to be a director as aforesaid. "

4. (1) The said Ordinance, as amended by chapter 37 Name of the Ordinances of 1903, is hereby further amended by substituting the name " Yorkton Queen Victoria Hospital" for the name "Queen Victoria Cottage Hospital at Yorkton" wheresoever it occurs therein.

(2) The change of name shall not affect any rights or obligations of the corporation, or render defective any legal proceedings by or against the corporation; and any legal proceedings that might have been continued or commenced against it by the former name may be continued or commenced against it by the new name.

5. Section 2 of the said Ordinance is amended by Section 2 substituting the words "two hundred thousand dollars" for the words "forty thousand dollars" where they occur in the last line of said section.

CHAPTER 77

An Act to amend An Act to incorporate The Lutheran
College and Seminary.

HEREAS a petition has been presented praying for the amendment of An Act to incorporate The Lutheran College and Seminary, being chapter 60 of the Statutes of Saskatchewan, 1924, to provide for the exemption of the undernamed land from taxation, except special assessment taxes which may at any time be levied by the municipality within which said lands are situated; and

Whereas it is expedient to grant the prayer of the said petitioner:

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Section 11 of An Act to incorporate The Lutheran s. 11, amended College and Seminary, being chapter 60 of the statutes of 1924, is amended by inserting at the end of the eleventh line thereof after the words "Province of Saskatchewan" the words:

"and that certain parcel or tract of land and premises being part of the north-east quarter of section twentytwo (22) in township thirty-six (36) range five (5) west of the third meridian, in the Province of Saskatchewan, Dominion of Canada, which may be more particularly described as follows: Commencing at a point in the north boundary of the said northeast quarter of section twenty-two (22) at a distance of one hundred and ninety-one and eight-tenths (191 and 8-10) feet more or less, easterly, from the north-west corner thereof, said point of commencement being the point of intersection of the east boundary of Jackson Avenue and the south boundary of Eighth Street as shown upon a plan of record in the Land Titles Office 1or the Saskatoon Land Registration District as Number G. 453; thence southerly along the eastern boundary of the said Jackson Avenue a distance of five hundred and seventy-five (575) feet more or less to the intersec

tion of the east boundary of the said Jackson Avenue and the south boundary of Seventh Street as shown upon the said plan of record No. G. 453; thence easterly along the southerly boundary of Seventh Street and the production thereof a distance of four hundred and fifty-six (456) feet more or less to the west boundary of a lane as shown upon a plan of record in the Land Titles Office for the Saskatoon Land Registration District as Number G. 127; thence north along the west boundary of the said lane to its intersection with the south boundary of Eighth Street; thence westerly along the south boundary of Eighth Street a distance of four hundred and fifty-four (454) feet more or less to the point of commencement; said above described parcel of land containing by admeasurement an area of six (6) acres be the same more or less; and that certain parcel or tract of land and premises which constituted all that portion of Jackson Avenue lying between Seventh and Eighth Streets in the City of Saskatoon, in the Province of Saskatchewan, according to a plan of record in the Land Titles. Office for the Saskatoon Land Registration District as No. G. 453 prior to the closing of that portion of said Avenue."
