Marine," and shall have and execute all the powers and duties vested And be it Enacted, That no salaries shall be paid to the said Commissioners, or any of them, in respect of their appointments under this Act, And be it Enacted, That it shall be lawful for the said Board, from 15 time to time, to appoint a Secretary and such Clerks and servants as they may deem necessary for the purposes of this Act, subject to the approval of the Commissioners of Her Majesty's Treasury, and every person so appointed shall be removable at the pleasure of the said Board; and it shall be lawful for the said Commissioners of the 20 Treasury, from time to time, to fix the remuneration or salaries of such Secretary, Clerks or servants, and to pay the same, together with all proper and reasonable expenses incurred by the said Board in the execution of this Act, out of the Consolidated Fund of the United Kingdom of Great Britain and Ireland. And be it Enacted, That the said Board shall cause to be made a seal for their use in the execution of this Act; and documents or copies of documents purporting to proceed from them, and to be signed by any Three or more of them, and to be sealed or stamped with such seal, shall be received as primâ facie evidence in all courts and places whatsoever. And be it Enacted, That from and after the Powers of the Board of Trade to the 25 30 all the duties now imposed upon the Lords of the said Board of Mercantile Committee of Privy Council for Trade by a certain Act passed in the Session of Parliament holden in the eighth and ninth Marine. 8 & 9 Vict., c. 116. of 35 years the reign of Her present Majesty, intituled, "An Act for the Protection of Seamen entering on board Merchant-ships;" and by a 9 & 10 Vict., c. 100. certain Act passed in the Session of Parliament holden in the ninth and tenth years of the reign of Her present Majesty, intituled, "An Act for the Regulation of Steam Navigation, and for requiring Sea- 40 going Vessels to carry Boats;" and all powers or authority now vested in the said Committee by or by virtue of the said recited Acts shall be transferred to, imposed upon, and vested in the said Board 5 Board of Mercantile Marine as fully as if the said Board had been named in the said Acts instead of the said Committee of Privy Council; and all provisions of the said Acts applicable to the Lords of the said Committee shall be deemed to apply to the said Board instead of the Lords of the said Committee; and all proceedings now pending before the Lords of the said Committee, or carried on under the authority in relation to the said recited Acts, or either of them, shall be continued and carried on by and before the said Board, who shall have and exercise the same powers, rights and authority in respect of 10 such proceedings as if they had been originally commenced before the said Board. AND whereas an Act was passed in the Session of Parliament holden in the sixth and seventh years of the reign of King WILLIAM the Fourth, intituled, "An Act for vesting Lighthouses, Lights and Sea15 marks on the Coasts of England in the Corporation of Trinity House of Deptford Strond, and for making Provisions respecting Lighthouses, Lights, Buoys, Beacons and Sea-marks, and the Tolls and Duties payable in respect thereof;" which Act is hereinafter designated and referred to as "The General Lighthouse Act:" AND whereas by the 20 said General Lighthouse Act, certain powers of supervision were conferred upon the Master, Wardens and Assistants of the Corporation of the Trinity House of Deptford Strond over the Lighthouses on the coasts of Scotland and Ireland respectively, notwithstanding such Lighthouses were continued to be under the control and management 25 of the Commissioners of Northern Lighthouses, and the Corporation for preserving and improving the Port of Dublin, hereinafter denominated the Ballast Corporation, and for this purpose the said Master, Wardens and Assistants, their engineers, workmen and servants, were empowered to enter the Lighthouses on the coasts of Scotland and 30 Ireland respectively; and the said Northern Lights Commissioners and the said Ballast Corporation were required before erecting or removing any Lighthouse, or altering the character thereof, or of the light exhibited therefrom, to give such notice as in the said Act is mentioned to the said Master, Wardens and Assistants, who were 35 thereby empowered to signify their disapproval or to make suggestions as the case might be: AND whereas it is expedient that the proceedings of the said Master, Wardens and Assistants, the said Northern Lights Commissioners and the said Ballast Corporation, should, so far as respects Lighthouses and the tolls thereof, be subject 40 to the direction and supervision of the said Board of Mercantile Marine, and that the said Northern Lights Commissioners and the said Ballast Corporation should no longer be subject to any control or supervision on the part of the said Master, Wardens and Assistants; BE it therefore Enacted, That the said Master, Wardens and Assistants, the said Northern Lights Commissioners and the said Ballast Corporation, shall, in the execution of their powers and 358. 6. Board of Mercantile superintendence as Tolls over the to Lighthouses and Trinity House of Deptford Strond, the Northern Lights Commissioners, and the Ballast Board Marine to have in Dublin. duties respectively vested in or imposed on the said respective And be it Enacted, That so much of the said General Lighthouse Act as authorizes the said Master, Wardens and Assistants, their engineers, workmen and servants, to enter the Lighthouses on the coasts of Scotland and Ireland respectively, or as requires notice to be given by the said Northern Lights Commissioners and the said Ballast Ballast Corporation respectively, to the said Master, Wardens and Assistants, in respect of erecting any new Lighthouse, or removing or altering any Lighthouse, or the character thereof, or of the light exhibited thereat, or as authorizes the said Master, Wardens and 5 Assistants to signify any disapproval or make any suggestion in reference thereto, shall be repealed. 25 AND whereas the Lighthouse tolls to which the said Master, Wardens and Assistants are entitled are by virtue of the said General Lighthouse Act applicable to pay off the whole or any part of the principal 10 money borrowed by the said Master, Wardens and Assistants, under the said Act, and the interest thereof, and are (but subject nevertheless to the due maintenance of Lighthouses under the management of the said Master, Wardens and Assistants) likewise applicable under or by virtue of divers Acts of Parliament, grants, charters or letters patent, 15 to the good government and increase of the navigation of this kingdoin, and to the better ordering and establishing of the said Corporation of the Trinity House, and to the relief of poor persons, brethren and the wives of brethren of the said Corporation, who are in decay, misery, poverty or need, and to the relief of poor mariners, their 20 widows and orphans: AND whereas by an Act passed in the third year of the reign of his late Majesty King GEORGE the Fourth, intituled, "Au Act for further continuing, altering and amending several Acts for the better Regulation of Lastage and Ballastage in the River Thames, and for enabling the Corporation of Trinity House of Deptford Strond to reduce, alter, modify, relinquish or abolish Dues payable to the said Corporation, and for other purposes connected therewith," the said Master, Wardens and Assistants were empowered from time to time, upon the requisition or with the consent of his then Majesty, his heirs and successors, in his or their 30 Privy Council, to reduce, relinquish, abolish, alter or modify all or any or either of the rates, prices, dues, duties or tolls granted to the said Master, Wardens and Assistants by grants, charters or Acts of Parliament, or levied and received under the authority thereof respectively, or by ancient usage, custom or prescription, or any part or 35 parts thereof, so far as might be consistent with the charitable and other uses, purposes and intents for which the said Corporation of Trinity House of Deptford Strond had been established or maintained; and by the said enactment now in recital it was provided, that no such rates, prices, dues, duties or tolls should at any time be increased 40 beyond the amount which might be levied or received by the said Corporation in respect thereof before the passing of the Act now in recital: AND whereas by the said General Lighthouse Act, the said Master, Wardens and Assistants, the said Commissioners and the said Ballast Corporation respectively, were empowered, upon the requisition or with the consent of Her Majesty in Council, to reduce, relinquish 8. Lighthouse Tolls. or modify, revive, establish or increase the Lighthouse tolls to which the said Master, Wardens and Assistants, the said Northern Lights Commissioners and the said Ballast Corporation were respectively entitled; but nevertheless in such manner and form, and subject to such conditions and limitations as the said Master, Wardens and Assistants 5 were at the time of passing the said General Lighthouse Act by law empowered, in respect of the tolls mentioned in the therein and hereinbefore recited Act of the third year of the reign of his said late Majesty King GEORGE the Fourth: AND whereas by reason of the limitations to the power of reducing and altering the 10 Lighthouse tolls payable to the said Master, Wardens and Assistants in the said recited Act of the third year of the reign of King GEORGE the Fourth contained, and by reason of the general and indefinite nature of the charitable and corporate objects to which the Lighthouse tolls payable to the said Master, Wardens and 15 Assistants are applicable, it is doubtful whether and to what extent Her Majesty in Council can absolutely require the said Master, Wardens and Assistants to reduce or modify their said Lighthouse tolls, and it is accordingly expedient that the purposes to which the Lighthouse tolls payable to the said Master, Wardens and Assistants 20 are to be applied, and especially the nature and extent of such of these purposes as are of a charitable nature, should be defined and declared; and it is also expedient that the power of altering and modifying the Lighthouse tolls payable to the said Master, Wardens and Assistants, the said Northern Lights Commissioners and the 25 said Ballast Corporation respectively, should be exercised by an authority independent of the said several Lighthouse Boards : AND whereas, in pursuance of the said grants, charters and letters patent, the said Master, Wardens and Assistants have for many years granted pensions for the relief of poor mariners, their widows and orphans, and of late years the average sum thus annually applied has been Twenty-five thousand Pounds, or thereabouts, and it is expedient that the like amount should be continued to be reserved by them out of the Lighthouse tolls to be applied in payment of such pensions, or otherwise, for the benefit of poor mariners, or their widows or 35 orphans, until otherwise directed by Parliament: AND whereas, in pursuance of the provisions, and in exercise of the powers of the said General Lighthouse Act, the said Master, Wardens and Assistants have, since the passing thereof, purchased the Lighthouses thereby directed to be purchased, and have for that purpose borrowed or 40 provided large sums of money: AND whereas the said Master, Wardens and Assistants have paid the interest due on such sums of money, and have repaid a considerable part of the principal thereof out of the surplus of the light dues received since the passing of the said General Lighthouse Act, and the principal now remaining due consists of the particulars described in the Schedule hereunto annexed: AND 30 |
