DECREE of the Queen of Portugal, respecting the Trade of British and other Foreign Nations with Portuguese Colonies. Lisbon, June 5, 1844. (Translation.)

Ir being necessary to declare which are the ports of the ultramarine provinces where vessels of those nations with whom the right of trading to those provinces has been stipulated, may be admitted; and the necessity of such declaration becoming daily more urgent, not only because the faith of Treaties so requires it, but likewise because from the want of such declaration great injuries may arise to commerce; at the same time that it is indispensable to organize the several Custom-houses according to the exigencies and the nature of the commerce of each port; such declaration being in like manner necessary to prevent the disputes which might easily arise from the want of a designation of the ports into which, in conformity with Treaties, foreign vessels are admissible; and whereas the security of the said provinces, a nd the maintenance and increase of the commercial relations between the different parts of the national territory, not less than the interests of the Portuguese producers, require that a designation should be made of the goods and merchandize the importation whereof into the ultramarine provinces is wholly prohibited, and of those others which can only be imported when of Portuguese production and conveyed in Portuguese ships: and whereas my Government, for this purpose, laid before the Chamber of Deputies the requisite proposition of a law, which the multiplicity of affairs and other circumstances that occurred did not allow to be discussed; I, having taken into consideration these reasons, and seeing that the said measures are especially necessary for the welfare of the ultramarine provinces, whose state requires that proper

measures should instantly be taken to raise them to that wealth and prosperity which they can only attain by means of licit commerce using the faculty conceded to me by the 1st Article of the Law of the 2nd of May, 1843, and having taken the opinion of the Council of Ministers and the Council of State, am pleased to decree the following:

Art. I. British vessels shall, in conformity to the stipulations of the Treaty of July 3rd, 1842,* entered into between the Portuguese and British Government, be admitted into the Portuguese Colonial ports designated in Table No. I. The commerce of the other Colonial ports not mentioned in the said Table shall be considered as coasting trade, and as such can only be carried on in Portuguese vessels.

II. The importation of the articles enumerated in the Table No. 2, is generally prohibited in all the Portuguese possessions, as also the importation of such articles as those possessions produce and usually export.

From this rule are excepted all articles produced in the surrounding countries when imported by land.

III. The goods and merchandize enumerated in the Table No. 3, will only be admitted into the Portuguese possessions when they are the produce or manufacture of the Portuguese dominions, and are conveyed in Portuguese vessels.

IV. Ships and goods proceeding from the possessions of the English East India Company shall be subject, in the Portuguese possessions, to an augmentation of duties equal to that paid by Portuguese ships and goods in the possessions of the said Company.

V. British vessels shall be allowed to convey to Foreign ports all the productions of the Portuguese possessions, excepting orchilla, and all such other productions as are or may hereafter be administered by the State, or by contract, and which can only be exported in national ships.

Both these sorts of productions shall be subject to the duties on exportation now existing or hereafter to be established.

VI. Into the ports designated in Table No. 1, will, in like manner, be admitted the vessels of the different nations with whom the liberty of trading to the Portuguese possessions has been stipulated.

VII. All legislation to the contrary is revoked.
