This Act may be cited as the "Water Act Amendment Act, Short title. 1913." 2. Chapter 239 of the " Revised Statutes of British Columbia, Granting powers 1911," being the "Water Act," as amended by chapter 49 of to Minister. the Statutes of 1912, is hereby amended by striking out the words "Lieutenant-Governor in Council" wherever those words appear in sections 75, 85, 91, 93, 98, 119, 120, 122, 152, 158, 161, 162, 163, 164, 165, 166, 167, 170, 179, 183, 196, 278, and 279, and substituting therefor the word "Minister "; and by adding after the words "Lieutenant-Governor in Council" wherever they appear in sections 84, 139, 199, 221, 222, 288F, 289A, and 328 the words "or the Minister"; and by striking out the words "Water Recorder" wherever those words appear in sections 200, 201, 202, 203, 205, 206, 210, 211, 212, 217, 219, 263, 264, 267, 268, 269, 289, and 289A, and substituting therefor the words "Engineer of the Granting powers water district." to Engineers of districts. 3. Section 2 of the said chapter 239, as amended by section 3 of chapter 49 of the Statutes of 1912, is hereby amended as follows:(1.) By adding after the interpretation of the word "Depart- Interpretation. ment" the following: "Board' or 'Board of Investigation' means the Board of "Board." Investigation created under Part III. of this Act: "Comptroller' means the Comptroller of Water Rights Comptroller." appointed under this Act, and shall include any person for the time being lawfully acting in that capacity." (2.) By adding after the interpretation of "commercial licence" the following: "Water-rights map' means the map as existing for the time being prepared under the direction or authority of the Minister pursuant to Part II. of this Act: "District' means and shall include one of the water districts into which the Province is divided pursuant to this Act: "Irrigation company' means a company authorized to have and exercise the powers and privileges conferred by Part XA. of this Act." (3.) By inserting after the word "all," in the third line of the interpretation clause of "water" or "stream," the word "streams.” (4.) By adding at the end of the interpretation clause of "domestic purposes" the words "and the irrigation of any garden not exceeding one-half an acre adjoining and occupied with any dwelling-house." (5.) By striking out the interpretation clause of "municipal purposes," and substituting therefor the following:"Municipal purposes' means and shall include the supply of water to any city, township, or district municipality or unincorporated locality for domestic purposes, and within the boundaries of any such municipality or unincorporated locality the supply of water to railways, manufacturers, and others for conversion into steam.” (6.) By striking out the interpretation clause of "non-commercial licence," and substituting therefor the following:"Non-commercial licence' means and shall include licences for domestic purposes for ten thousand gallons of water or less per day; licences for the irrigation of one hundred and sixty acres of land or less; licences for industrial purposes for four cubic feet or less of water per second; licences for mining purposes for ten cubic feet or less of water per second; and licences for the utilization of mineral water or the water of springs." 4. The said chapter 239 is hereby amended by adding after section 7 the following section: "7A. The Minister may cause to be prepared in and for each water district, or any portion or portions thereof, a water-rights map, which shall show the location, points of diversion, conduits, places of user, and such works, references to records or licences, and other particulars relating to the water in such district or portion of a district as the Minister may deem advisable." 5. Section 8 of the said chapter 239 is hereby amended by inserting after the word "Province," in the second line of the said section, the words" and Engineers." of Board. 6. Section 9 of the said chapter 239 is hereby amended by Jurisdiction striking out the words " or other water rights " in the fourth and fifth lines thereof, and substituting therefor the words "and all other claims and rights to the use of water"; and by striking out "this Part of " in the tenth line of the said section. 7. The said section 9 is hereby further amended by striking out Private Acts. the word "public" in the fifth line thereof. 8. Section 10 of the said chapter 239, as amended by the said Member of Board. chapter 49, is hereby amended by inserting after the words "consist of," in the first line thereof, the words "a Chairman "; and by striking out the words "the Comptroller of Water Rights." 9. Section 12 of the said chapter 239, as amended by section 2 of Chairman of Board. the said chapter 49, is hereby amended by striking out the words. "Comptroller of Water Rights" in the first line thereof, and sub stituting therefor the word "Chairman." 10. Section 14 of the said chapter 239, as amended by the said Taking oath of office. chapter 49, is hereby amended by striking out the words "Comptroller of Water Rights or of a" in the third and fourth lines of the said section as amended as aforesaid; and by striking out the words "as the case may be" in the fifth line of the said section; and by inserting before the word "member" the word "the" in the third line of section 7 of the said chapter 49. 11. Section 19 of the said chapter 239 is hereby amended by Survey of streams. striking out the word "conveying" in the fourth line of the said section, and substituting therefor the words "storing, carrying." 12. The said chapter 239 is hereby amended by adding after section 19 the following section: Engineer. "19A. The Board may call upon any engineer who has made the Evidence of examination referred to in the last preceding section and upon the Engineer and Water Recorder of the district for all data in their respective possession relating to the said examination, and for any recommendation and advice in respect of any claim to which the said examination relates which is being investigated by the Board." 13. The said chapter 239 is hereby amended by adding after section 21 of the said chapter the following section: "21A. Where a record shall have been heretofore granted for the Prescriptive rights.. use of water for any specific purpose, and the water referred to in such record or some portion thereof shall have been actually enjoyed without interruption for the full period of twenty years for some other purpose than that for which it was recorded, but for which water might have been recorded, or where water claimed under a record which is lost or cannot be produced has been actually enjoyed without interruption for some purpose for which such water might Notice to file claims. Statement of claim. have been recorded for the full period of twenty years, the right to such waters respectively shall be absolute, and shall not be defeated by reason only that the record was for some other purpose than that for which it has been so used, or that the record is not produced (as the case may be), unless it shall be proved that the said water was so enjoyed by some consent or agreement in writing for that purpose entered into by some person entitled to such water and who could legally object to such enjoyment." 14. Section 22 of the said chapter 239 is hereby amended by inserting after the word "thereof," in the seventh line of the said section, the words "or specifying the locality as to claims within which the investigation will be held"; and by adding after the word "stream," in the eighth line of the said section, the words "or in such locality"; and by striking out the words "come in and present" in the eighth and ninth lines of the said section, and substituting therefor the word "file." 15. Section 24 of the said chapter 239, as enacted by chapter 13 of the said chapter 49, is hereby amended by striking out the words "In the event of inability or serious inconvenience to give personal notice, the " in the seventh, eighth, and ninth lines of the said section 13, and substituting therefor the word "The "; and by inserting after the word "by," in the said ninth line of the said section, the word "registered"; and by striking out the word "however" in the eleventh line of the said section; and by striking out the word "sufficiency" in the said eleventh line, and substituting therefor the word "form." 16. Section 26 of the said chapter 239 is hereby amended by striking out the word "present" in the sixth line of the said section, and substituting therefor the word "file." 17. Section 27 of the said chapter 239, as amended by section 16 of the said chapter 49, is hereby amended by adding after the word "district," in the fourth line of the said section, the words "or any person thereto authorized by the Board"; and by striking out the words "on instructions from the Board" in the fourth and fifth lines of the said section; and by inserting after the word "time," in the fifth line of the said section 27, the words "and place"; and by striking out the words "by" and "he" in the seventh line of the said section 27. 18. Section 28 of the said chapter 239, as amended by section 17 of the said chapter 49, is hereby amended by striking out the word "presents" in the third line of the said section 28, and substituting therefor the words "files with the Board"; and by inserting after the word "writing," in the said third line, the words "in respect of each record"; and by striking out in the next line the words |
