Specimen Schedule of Conditions.

Town Planning (General Interim Development) Order, 1922.

Schedule of Conditions referred to in permission of the Council, dated the

Here specify conditions,* e.g. :—

1. No buildings to be erected on the land which is coloured

on

the Plan and is intended to be reserved for the sites of streets to be laid out in accordance with the following cross-sections :

2. No buildings to be erected on the land which is coloured

the Plan and is intended to be reserved for acquisition by the Council for a public open space, and no buildings to be erected on the land which is coloured and is intended to be reserved as a private open space other than buildings required for its use for that purpose (i.e. as a private ground for sports, play, rest and recreation, or as an ornamental garden or pleasure ground).

3. No part of any building (except, e.g. bay-windows, porches, and other similar projections), and no structure other than boundary walls and fences to be erected in advance of the building lines shown by lines on the

Plan.

4. No buildings other than dwelling-houses (a dwelling-house being a house designed for use as a dwelling by a single family, with such outbuildings as are ordinarily required to be used therewith) and † to be erected, except

*The conditions are illustrations only, and the Council should not make any requirements that are not really essential. The conditions need only be specified so far as the plan itself does not adequately indicate them.

The unit of measurement should normally include private streets, private open spaces, and half the width of any public road on which the land abuts (or the whole of the road, where the land abuts on both sides). Public open spaces and public allotments can also be included to the extent considered appropriate.

MODEL FORM OF PRELIMINARY STATEMENT TO BE PREPARED IN ACCORDANCE WITH THE SECOND SCHEDULE TO THE MINISTRY OF HEALTH (TOWN PLANNING) REGULATIONS, 1922.

NOTE.-In the Memorandum issued by the Minister of Health with this Model Form in February, 1923, it is observed: "It will be convenient if the Local Authority will follow the form as far as possible in preparing the Preliminary Statement; the form itself is intended only as a model and not for actual use."

PRELIMINARY STATEMENT.

(The particulars are to be illustrated, so far as possible, on a map marked No. 2, according to the system of notation appended hereto-see pp. 203 and 204.)

AREA.

(1) Area to be included in the Town Planning Scheme.

The area should be defined by reference to the inner edge of a coloured boundary line shown on Map No. 2..

STREETS.

(2) The principal new streets and widenings which it is proposed shall be made as part of the scheme, with their position, and building lines proposed to be prescribed in relation thereto.

The new streets should be numbered consecutively and distinctly, and the length to which each distinguishing number refers, and the width, should be clearly marked on the map.

DENSITY.

(b) Density of buildings (that is, number of dwelling-houses to the acre and proportion of site allowed to be covered by buildings).

Proposed Method of Calculating Density.-The average number of houses per acre to be calculated over units of land to be approved by the Council, the units to be within one ownership, unless otherwise agreed, and to include in addition to private land, and private streets, half the width of any public road on which the land abuts, and, to the extent permitted by the Council, public open spaces and public allotments.

The Council to have power to permit an increase of average density in cases of difficulty in developing land on account, e.g. of the lay-out of streets constructed before the date of the Council's resolution deciding to prepare a scheme, or the small amount of land in the possession of any owner on that date.

(ii) Proportion of site to be allowed to be covered by buildings.

Example.-Subject to exceptions in the case of extensions of buildings in existence or commenced on the (the date of the resolution of the Council deciding to prepare a town planning scheme) or in other special cases, the proportion of site to be covered by buildings of various classes not to exceed that indicated in the appropriate column of the following table :

Information as to any proposed restrictions on the heights of buildings. Example.-Except in the case of industrial buildings in the areas coloured (i.e. industrial areas) or, with the consent of the Council, in the case

of public buildings.

(i) no part of any new building to project above a line drawn from the centre of the street in front of the building (or, where more than one street, the widest street) at an angle of 56° with the horizontal; or 45° in the case of subsidiary streets intended for residential use only.

(ii) the highest point of any new building in no case to exceed 70 feet.

For the purpose of measurement, account to be taken of parapets, but no t of chimneys, ornamental towers, turrets or any other architectural features. (Where different heights are to be permitted in different areas, they should be shown by means of a table as in the case of the density proposals.)
