secuting clerk" probably derive no inconsiderable advantage from the prosecutions which take place at the borough sessions, and thus any individual whom a magistrate might think proper to bind over in a number of cases would secure no trifling emolument, provided he took the precaution to enter into a kind of partnership agreement with an attorney.

But the matter does not rest here. The public is concerned. Every man has a right, and has hitherto been allowed, to employ his own attorney-the person in whom he can confide-and it is, to say the least, a gross act of injustice to compel him to take his business to an individual of whom he has not the

slightest knowledge. Felonies, embracing the abstraction of property in various ways, to a serious amount, frequently occur, and great skill and care is often required on the part of the attorney employed to prosecute the offenders; and it only seems reasonable that the real prosecutors should be allowed to engage professional advisers on whose abilities they can rely. But with respect to the "prosecuting clerk " I do not mean to insinuate that he is unfit for the situation which he has accepted. I believe his family and connexions are respectable, and, for aught I know, he may be quite as competent to conduct a prosecution as any other gentleman. FAIRPLAY.
