PREFACE.

SINCE the publication of the last Edition

of this Work there has been but little legislation affecting the law relating to vendors and purchasers, although two Conveyancing Bills have been introduced-one of which (No. 79 of 1908) is now standing over until the Autumn Session. The Married Women's Property Act of 1907 has, however, removed the difficulties arising out of the decisions in Harkness and Allsopp's Contract and Stevens v. Trevor-Garrick. The decisions of the courts with regard to vendor and purchaser law, although not numerous, have been of considerable importance; and in particular it may be pointed out that three recent decisions tend to curtail the exercise by the vendor of his right of rescission; while the decision of the Court of Appeal in Nisbet and Pott's Contract
