AN ACT to further amend the Adoption of
Children Act, 1896.

[Assented to 17th November, 1916.]

BE it hath the advice and consent of the Legislative

E it enacted by the King's Most Excellent Majesty, by

Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Adoption of Children Act Short title. Amendment Act, 1916, and shall be read as one with the Adoption of Children Act, 1896, hereinafter referred to as the principal Act.

Section 3.

2. Section three of the principal Act is hereby amended Amendment of by substituting for the words "married woman" in paragraph (3) the words "unmarried woman or a widow," and by substituting for the words "married man in paragraph (4) the words

"unmarried man or a widower."

3. Section four of the principal Act is hereby amended by inserting after the word "man" in paragraph (3) in paragraph (3) "or a widower,' and by inserting after the word "woman in paragraph (4) "or a widow."

4. All copies of the principal Act hereafter printed by the Government Printer shall be printed as amended by this Act, under the superintendence of the Clerk of Parliaments, and a reference to this Act shall be made in the margin.

HEREAS on the thirtieth day of July One thousand nine Preamble. hundred and fifteen funds were raised in the State of Western Australia on behalf of the Western Australian Division of the Australian Branch of the British Red Cross Society by a movement known as "The Western Australian Day for the Sick and Wounded": AND WHEREAS the Honorary Treasurer, with the approval of the Executive Committee of such movement, has handed over the Funds so raised to the Honorary Treasurer of the Western Australian Division of the Australian Branch of the British Red Cross Society, to be applied in a manner consistent with the basis on which the subscriptions were sought: AND WHEREAS it is desirable that power should be conferred upon the Divisional Committee of the Western Australian Division of the said Branch to apply such Funds accordingly: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent

of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as The Western Australian Day Funds Act, 1916.

2. It shall be lawful for the Divisional Committee of the Western Australian Division of the Australian Branch of the British Red Cross Society to expend the funds raised in the said State by the movement known as "The Western Australian Day for the Sick and Wounded," not only for the objects of the British Red Cross Society as stated in its charter of incorporation, but also for the benefit, assistance, and advancement of soldiers and sailors and other members of His Majesty's Forces (whether discharged or undischarged) returned sick and wounded to the said State, or who may have been prevented from leaving the State by reason of injury, incapacity, or sickness suffered whilst on service, as in its discretion the said Committee may think fit.

It shall also be lawful for the said Divisional Committee, in its discretion, from time to time out of the said funds to pay moneys to the War Council of Western Australia to be expended by such Council for any of the purposes herein before mentioned, and the receipt of the Secretary of the War Council of Western Australia, or other officer carrying out the duties of such Secretary, shall be a sufficient discharge to the said Divisional Committee for the moneys so paid by it, and shall effectually exonerate the British Red Cross Society and all Branches and Divisions thereof from seeing to the application of such moneys so paid as aforesaid to the War Council of Western Australia, and from being answerable for any loss or misapplication thereof.

Provided that nothing herein contained shall restrict the distribution of such portion of the said funds as may, by the authority of the Supreme Court, be distributed amongst military hospitals in England, Egypt, Malta, and elsewhere outside the said State.

2. It shall be lawful for the Governor to grant, under the provisions of Division (3) of Part V. of the Mining Act, 1904, a Mineral Lease of any portion of the permanent Reserve (National Park).
