It seems clear that the imposition of the heavy preferential duties to which foreign goods are subjected by the recent Decree, coupled with such official support as is given in the Governor-General's Circular, and followed, as it is sure to be, by similar, if not greater, assistance on the part of the subordinate officials, must inevitably have a tendency, not merely to cripple, but ultimately even to extinguish British trade. M. le Ministre, || I have received instructions from Her Majesty's Government to call your Excellency's serious attention to a Circular recently issued 22. Juli1898, by the Governor-General of Madagascar, which, in their opinion, is calculated to inflict direct injury upon British trade, and is in contravention of the rights assured to Great Britain by Treaty. || The Circular in question, which is published in the Madagascar „Official Journal" of the 23rd April last, gives instructions to the native authorities to use all their influence in favour of the extension of French trade and industry, and with this object to impress upon the natives to use only goods of French manufacture as a mark of patriotism and an act of duty. || It is true that General Gallieni thinks it advisable to remind the authorities that no obstacle shall be placed on the sale and circulation of foreign goods, but it is difficult to see how his warning can be compatible with the due execution of the Governor-General's instructions; and the whole tenour of the Circular is a strong recommendation amounting almost to an injunction to them to discourage all foreign commerce and industries. || There is incidental evidence that the authorities have not been slow to follow this advice, and from information which has reached Her Majesty's Government, it appears that action has been taken in the provinces to prevent the native traders dealing with any but French merchants. || The action of the Governor-General has, moreover, not been confined to the publication of this Circular, for copies of the "Official Journal" have been widely distributed containing illustrations of French trade-marks, and warning the natives to avoid goods bearing any other. || Such action, in the opinion of Grofs Her Majesty's Government, exceeds all the limits of fair competition, and is Nr. 11680. inconsistent with the repeated assurances given to them by the Government britannien. of the Republic, that the rights and immunities enjoyed by British subjects 22. Juli 1898. in Madagascar and its dependencies will continue to be respected. || In calling your Excellency's urgent and earnest attention to this matter, I trust I may rely upon your support in putting a stop to a system which cannot but give rise to serious difficulties in connection with the trade of Great Britain with Madagascar. || I need hardly remind your Excellency of the conversation which I had the honour to hold with you the day before yesterday, when, by the instruction of Lord Salisbury, I handed to your Excellency a copy of a despatch which his Lordship had addressed to me recapitulating the various assurances given to Her Majesty's Government by that of the Republic before the annexation of the island to France, that the Treaty rights of Great Britain should be respected; and protesting against the manner in which they have been subsequently ignored. || I gathered from your Excellency's language that you were ready to give these representations a prompt and impartial consideration, and I cannot but believe that your study of the question will lead you to the conclusion that they are fully justified by the facts adduced. Juli 1898. pable effect will be to put a stop to all British trade in Madagascar, in contravention of the Treaty rights of Great Britain. || I have now to call your Excellency's further attention to the new duties imposed by the Decree of the 31st May last upon certain classes of cotton tissues. || Her Majesty's Government directed that a careful inquiry should be made into their incidence, and this inquiry shows that the new rates will involve a very material increase in the duties levied in the class of cotton goods which form the bulk of the exports from Great Britain to Madagascar. || To cite one or two instances, I may state that on grey sheeting, (which is the most important class of the goods in question), the duty under the Tariff in question was equivalent to 45 per cent ad valorem, and the new duty to 56 per cent., or a rise of 11 per cent, ad valorem. On grey shirtings (the next most important class), the former duty ranged from about 44 to 64 per cent. ad valorem, and the new duty from 54 to as much as 79 per cent., a rise of from 10 to 15 per cent, ad valorem. || The general result of the new Tariff on cotton britannien. Nr. 11681. will be to put a stop to the greater part of British trade with Madagascar, Grofs- and I am instructed by Her Majesty's Government to protest formally against 22. Les titulaires de baux emphytéotiques consentis, soit par des indigènes qui ne peuvent justifier de leur droit de propriété, soit par des indigènes qui ont disparu sans laisser d'héritiers au degré successible suivant les coutumes Malgaches, ou dont les héritiers sont inconnus, pourront, sous réserve des besoins de la Colonie, et après assentiment du Gouverneur-Général, se faire délivrer des titres de vente définitive par la Colonie en ce qui concerne les immeubles qui auront été mis en valeur. Art. 6. Dans ce but, ils adresseront au Chef de la Province où se trouve situé l'immeuble une déclaration qui contiendra: || 1. Les nom, prénoms, surnoms, et domicile du déclarant. || 2. La description de l'immeuble et l'indication de la situation, c'est-à-dire de la province, de la ville ou du village de ses tenants et aboutissants, la date du bail emphytéotique, le nom du bailleur, ainsi que tous les renseignements qui seraient à leur connaissance au sujet de ce dernier. || 3. La mention que le propriétaire de l'immeuble a disparu et que les recherches faites sont restées infructueuses. Ils joindront à leur déclaration l'acte de bail dont il leur sera donné récépissé. Art. 7. Dans le plus bref délai possible, le Chef de la Province fera afficher dans le lieu destiné aux annonces officielles et dans les marchés de sa circonscription, par les soins des autorités Françaises ou indigènes, une publication dans laquelle il invitera le propriétaire, ses héritiers ou ayants droit, à se faire connaître dans le délai de trois mois, faute de quoi la propriété fera retour à la Colonie. || L'accomplissement de toutes ces formalités sera constaté par un procès-verbal de l'autorité qui y aura procédé.
