Etant la PREMIERE Session du Conseil Spécial, Commencée et tenue en la Cité de Montréal, dans la dite Province du Bas-Canada, le dix-huitième jour d'Avril, Anno Domini 1838, dans la première année du règne de Notre Souveraine Dame Victoria, par la grâce de Dieu, Reine du RoyaumeUni de la Grande-Bretagne et d'Irlande, Protectrice de la Foi, &c., et qui a terminée le cinquième jour de Mai, de la même année. Preamble. Laws and Ore dinances to take effect from the date on which they shall have been assented to by the Go vernor, &c. CAP. I. An Ordinance to declare and ascertain the period when the Laws and Ordinances made and passed by the Governor, or Person authorized to execute the Commission of Governor, and Special Council of this Province, shall take effect. W HEREAS it is expedient that the period, from which the Laws or Ordinances of the Governor, or Person authorized to execute the Commission of Governor, and Special Council for the affairs of this Province, are to have operation and effect, should be declared and ascertained; Be it therefore Ordained and Enacted by His Excellency the Administrator of the Government of this Province, authorized to execute the Commission of the Governor thereof, by and with the advice and consent of the Special Council for the affairs of the said Province of Lower Canada, constituted and assembled by virtue of and under the authority of an Act of the Parliament of the United Kingdom of Great Britain and Ireland, passed in the first year of the Reign of Her present Majesty, intituled, "An Act to make temporary provision for the Government of Lower Canada ;"—And it is hereby ordained, and enacted by the authority of the same, that the Clerk of the Special Council for the affairs of this Province, or, in his necessary absence, the Assistant Clerk of the said Special Council, shall, on every Law or Ordinance which shall hereafter pass or be made by the Governor, or Person authorized to execute the Commission of Governor of this Province, with the advice and consent of the Special Council for the affairs of this Province, state under his signature, as such Clerk, or Assistant Clerk, immediately after the signature of the Governor, or Person authorized, as aforesaid, the day, month, and year when the same shall have passed, and shall have been assented to by the Governor, or Person authorized to execute the Commission of Governor of the said Province, and shall have had the Great Seal of the said Province affixed; and such statement, under such signature, shall be taken to be a part of every such Law or Ordinance, and the day, month, and year, in such statement mentioned, shall be the date of its commencement, when no other period of commencement shall be declared or provided, in and by such Law or Ordinance. Ordonnance pour déclarer et rendre certaine l'époque où les Lois et Ordonnances faites et passées par le Gouverneur ou la Personne autorisée à exécuter la Commission de Gouverneur, et le Conseil Spécial de cette Province, auront effet. A TTENDU qu'il est expédient que l'époque à partir de laquelle les Lois et Préambule. Ordonnances du Gouverneur, ou de la personne autorisée à exécuter la Com. mission de Gouverneur, et du Conseil Spécial pour les Affaires de cette Province, devront avoir force et effet, soit déclarée et rendue certaine : Qu'il soit, en conséquence, Ordonné et Statué par Son Excellence l'Adininistrateur du Gouvernement de cette Province, autorisé à exécuter la Commission de Gouverneur d'icelle, par et de l'avis et consentement du Conseil Spécial pour les affaires de la dite Province du Bas-Canada, constitué et assemblé en vertu et sous l'autorité d'un Acte du Parlement du Royaume-Uni de la Grande-Bretagne et d'Irlande, passé dans la première année du Règne de Sa présente Majesté, intitulé, "Acte pour établir des dispositions "temporaires pour le Gouvernement du Bas-Canada," et il est par les présentes ordonné et statué par l'autorité d'iceux, que le Greffier du Conseil Spécial pour les Affaires de cette Province, ou, en son absence nécessaire, l'Assistant.Greffier du dit Conseil Spécial, à chaque Loi ou Ordonnance qui sera passée ou faite par le Gouver- Ordonnances neur ou la personne autorisée à exécuter la Commission de Gouverneur de auront effet du cette Province, de l'avis et consentement du Conseil Spécial pour les affaires jour où elles de cette Province, déclarera sous sa signature, comme tel Greffier, ou Assistant- l'assentiment Greffier, immédiatement après la signature du Gouverneur ou de la personne &c. autorisée comme susdit, les jour, mois et année où icelle aura été passée, où le Gouverneur ou la personne autorisée à exécuter la commission de Gouverneur de la dite Province, y aura donné son assentiment, et où le Grand Sceau de la dite Province y aura été apposé; et telle déclaration, sous telle signature, sera censée faire partie de telle Loi ou Ordonnance, et les jour, mois et année mentionnés dans telle déclaration seront la date de son commencement, lorsqu'il ne sera déclaré ou fixé aucune autre époque de commencement dans et par telle Loi ou Ordonnance.
