CHAPTER 86.

An Act to amend "The Public Schools Act."

[Assented to January 28th, 1916.]

IS MAJESTY, by and with the advice and consent of the
Legislative Assembly of Manitoba, enacts as follows:-

1. Chapter 165 of the Revised Statutes of Manitoba, 1913, "The Public is hereby amended as follows:

If for any cause the board of trustees of any school district deems it inadvisable or inexpedient to keep its school open trustees to open as provided in paragraph (ƒ) of section 57 of this Act, it shall submit a statement of the facts to the Department, which in its discretion shall have power to make such order with respect thereto as it may deem fit, and it shall be the duty of the board to carry out the provisions of such order.

97. (1) Notwithstanding anything contained in this Act every council of a rural municipality shall have power by by-law to form a school district comprising all the lands contained in and to establish such municipality save and except therefrom such lands as are comprised in any union school district or school districts, and to establish a board of school trustees therefor, on the approval of such by-law by a majority of all the duly qualified municipal electors in such district who vote on such by-law at any municipal election.

(2) Every council of a rural municipality shall have power to submit such by-law to the municipal electors at any municipal election; and the council of any rural municipality shall, on receipt, prior to the first day of October in any year, of petitions from fifteen per cent. of the duly qualified resident municipal electors whose names appear upon the last revised municipal voters' list, submit a by-law to the said electors at the next ensuing municipal election providing for the establishment of such a board; all the provisions of "The Municipal Act" relating to the submission of a by-law to a vote of the electors shall apply to the submission of such by-law.

(3) The first election of municipal trustees shall take place on the third Monday in July following the passing of the said by-law, two trustees being elected for each of the wards into which the municipality is divided, and the said trustees shall take office on the first day of August following; and after the first election one of the said trustees in each ward (to be
