CHAPTER 113.

An Act to amend and legalize By-law No. 5 of the School
District of The Pas, Number 1635, and By-law

No. 71 of the Town of The Pas.

HEREAS the school trustees of the School District of Preamble. The Pas, number 1635, on the twelfth day of April, 1915, passed a by-law, No. 5, set forth in the schedule hereto annexed, marked B, and entitled "By-law of the school trustees for the School District of The Pas, number 1635, for the purpose of borrowing the sum of thirty thousand dollars and of issuing debentures therefor"; and whereas the council of the Town of The Pas, on the seventeenth day of May, 1915, at the request of the said school trustees passed a by-law No. 71 set forth in the schedule hereto annexed, marked C, and entitled "A by-law to authorize the issue of debentures to the amount of $30,000 to pay for the erection of a school house in The Pas School District, No. 1635, and for the equipment thereof," by virtue of which the matter was submitted to the electors of the said school district for their approval, and voted upon on the fourteenth day of June, 1915, and the same was approved of by the requisite majority; and whereas it is expedient to amend said by-laws and to change the date of said debentures (set out in said schedule B) to the first day of February, 1916, and to make each of said debentures, and the coupons of each of said debentures, payable at the office of the Canadian Bank of Commerce, in the City of New York, in the United States of America, instead of as in said by-laws provided, and also to legalize and validate the said by-laws as amended and the debentures and the coupons attached thereto which are to be issued under the said amended by-laws and under this Act,

6. Pursuant to section 219 of "The Public Schools Act" the Department of Education may assent to and approve the said debentures when issued, and the Provincial Secretary may endorse the said debentures when issued under the terms of the said Act, with the same effect as if the said by-laws had always contained the amendments made by this Act.

7. This Act shall come into force on the day it is assented to, and the said by-laws shall be construed as if they had each always contained the amendments made by this Act.

SCHEDULE B.

BY-LAW No. 5.

(Referred to as Schedule A in By-law No. 71 of the Council of the town of The Pas.)

By-law of the school trustees of the School District of The Pas, No. 1635, for the purpose of borrowing the sum of thirty thousand dollars, and of issuing debentures therefor.

Whereas the school trustees for the School District of The Pas, No. 1635, duly assembled, enacts as follows:

(1) That it shall be lawful for the said school trustees to borrow the sum of thirty thousand dollars by the issue and sale of twenty debentures of the said school district, each for the sum of fifteen hundred dollars of lawful money of Canada.

(2) That the said debentures shall bear the date of the first day of June, A.D. 1915, and shall be payable to the bearer at the office of the Canadian Bank of Commerce in the Town of The Pas in the Province of Manitoba.

(3) That each debenture shall be signed by the secretary-treasurer and countersigned by one of the trustees of the said school district; and that each coupon shall be signed by said secretary-treasurer.

(4) That the said debenture shall bear interest at the rate of six per cent. per annum from the date thereof, payable annually on the first day of February in each year, on the presentation of the interest coupons attached thereto at the said office of the Canadian Bank of Com

merce.

(5) That provisions shall be made out of the annual school tax for the payment of the said debentures and interest and such provisions shall form part of and be included in the annual statement of moneys required for the purpose of the said school district.

Done and passed by the said school trustees of "The School District of The Pas, Number 1635" assembled at the Town of The Pas in the Province of Manitoba this Twelfth day of April, A.D. 1915.

A by-law to authorize the issue of debentures to the amount of $30,000.00 to pay for the erection of a school house in The Pas School District No. 1635 and for the equipment thereof.

Whereas the school trustees of the School District of The Pas, No. 1635, on the twelfth day of April, 1915, passed a by-law to borrow the sum of thirty thousand dollars by the issue and sale of twenty debentures of the said school district, each for the sum of $1,500.00 of lawful money of Canada as shown in schedule A hereto annexed; and whereas it is advisable that the municipal council of the Town of The Pas grant the request of the Board of School Trustees for the School District of The Pas, No. 1635; and whereas in order thereto it will be necessary to issue the debentures of the said school district for the sum of thirty thousand dollars as hereinafter provided, (which is the amount of debt intended to be created by this by-law) the proceeds of the said debentures to be applied to the purpose aforesaid and to no other; and whereas it is advisable to issue the said debentures at one time, and to make the principal of the said debt repayable at stated times during the period of twenty years, being the currency of the said debentures; and whereas the amount of the whole rateable property of The Pas School District,No. 1635, according to the last revised assessment roll thereof is $2,843,592.60; and whereas there is no existing debenture debt of The Pas School Dis
