1. The Metalliferous Mines Regulation Act, 1872, applies to Sec. 3. every mine of whatever description, except

1. Coal mines,
2. Mines of stratified ironstone, which are subject to the Coal
3. Mines of shale,

Mines Regulation Act, 1872.
4. Mines of fireclay,
The Act extends to the Isle of Man.
2. Definition of Mine. The term “mine”

a mine to which the Metalliferous Mines Regulation Act, 1872, applies, and includes

every shaft in course of being sunk, and every level and inclined plane in the course of being driven, for commencing or opening any new mine, or for searching or proving minerals, and Sec. 41. all the shafts, levels, planes, works, machinery, tramways, and sidings, both below ground and above ground, in and adjacent to a mine and any such shaft, level, and inclined plane, and belonging to the mine. The term “shaft” includes pit.

3. The commencement of the Act is 1st January 1873.

Sec. 2.

Inspectors. 4. Inspectors of mines are to be appointed by a Secretary of Sec. 15. State, and a district to be assigned to each.

5. An inspector may not himself be or practice, or be the partner Sec. 16. of one who is or who practices, as land agent or mining engineer, or as a manager, viewer, agent, or valuer of mines, or as arbitrator in mining cases, and may not be otherwise employed in or about any mine, whether such mine is one to which the Act applies or not.

6. In order to ascertain whether the provisions of the Act are Sec. 17. observed both above ground and below ground, the inspector is authorised to examine any mine by day or by night, so, however, as not to impede the working thereof; and owners and agents, and all employed in or about the mine, are bound to render him every assistance in conducting such examination.

7. Each inspector is to make to a Secretary of State an annual Sec. 20. report of his proceedings to be laid before Parliament, and when directed is to make a special report as to any mine accident
