CHAPTER 34

An Act respecting Agreements for Payment to
Vendors, Lessors and Others by Shares of

Crops.

[Assented to June 24, 1915.]

HIS

IS Majesty by and with the advice and consent of the
Legislative Assembly of Saskatchewan enacts as follows:

1. This Act may be cited as "The Crop Payments Act." Short title

In all cases in which a bona fide lease has been made Payment of and a bona fide tenancy created between a landlord and of the crop tenant, providing for payment of the rent reserved or any part thereof, or for payment in lieu of rent, by the tenant delivering to the landlord a share of the crop grown or to be grown on the demised premises, or the proceeds of such share, then, notwithstanding anything contained in The Chattel Mortgage Act, or in any other statute, or in the common law, the lessor, his personal representatives and assigns shall, without registration, have a right to the said crops or the proceeds thereof to the extent of the share or interest reserved or agreed to be paid or delivered to him under the terms of such lease, in priority to the interest of the lessee in said crops or the proceeds thereof, and to the interest of any person claiming through or under the lessee, whether as execution creditor, purchaser, or mortgagor or otherwise.

3. When land has been sold under an agreement of sale Payment of providing for payment of the purchase money or part thereof price of land by by the purchaser delivering to the vendor a share of the crops grown on the said land or paying to the vendor the proceeds. of such share, then, notwithstanding anything contained in The Chattel Mortgage Act or in any other statute, or in the common law, the vendor, his personal representative and assigns shall, without registration, have a right to the said crops or the proceeds thereof to the extent of the share or interest agreed to be delivered or paid over; in priority to the interest of the purchaser, his personal representative or assigns in such crops or the proceeds thereof, and to the interest of any other persons claiming through or under the purchaser, his personal representatives or assigns, whether as execution creditor, purchaser, mortgagee or otherwise.

4. Where payments are to be made by a mortgagor to a mortgagee of mortgage moneys or interest by the mortgagor delivering to the mortgagee a share of the crops grown upon the mortgaged premises, the mortgagee shall have the same right to such share as is given to a vendor in respect of payments of purchase money by the preceding section of this Act, and he shall have the same protection against claims of execution creditors, mortgagees or other persons claiming by, through or under the person who is to make the payments.

An Act to amend The Agricultural Aids Act.

IS Majesty by and with the advice and consent of the Legislative Assembly of Saskatchewan enacts as follows:

1. Section 2 of The Agricultural Aids Act, being chapter 57 of the statutes of 1913, is hereby amended by adding thereto the following as clause (e) thereof:

"(e) For such other purposes of assistance to agricultural enterprises as may be authorised from time to time. by the Lieutenant Governor in Council."

An Act to amend An Act to incorporate The
Saskatchewan Grain Growers' Association.

HEREAS it is desirable to more effectually enable The Saskatchewan Grain Growers' Association to aid in the marketing of farm produce and in the obtaining of farm supplies, and to obtain capital therefor:

Therefore his Majesty by and with the advice and consent of the Legislative Assembly of Saskatchewan enacts as follows:

1. Chapter 54 of the statutes of 1908, being An Act to incorporate The Saskatchewan Grain Growers' Association, and amendments thereto is further amended by adding thereto the following sections:

6. The said association may carry on the business of wholesale purchasers, shippers or dealers in the products of agriculture and of the farm, including therein in addition to the direct products of the soil such as hay, grain, roots, vegetables, fruits and other crops, such farm products as milk, cream, butter, cheese, poultry, eggs, hides, skins, wool, meats and live stock and the business of wholesale procurers, shippers and dealers in agricultural and farm supplies, including therein live stock, all goods, wares, merchandise, lumber, building materials, fencing, machinery, implements, tools and commodities ordinarily used in agriculture and farming and in or about a farm or ranch, and the said association shall have power to do anything incidental or conducive to the attainment of the above objects.

"7. The association shall have power to borrow money for the purpose of carrying out its objects, and to hypothecate, pledge or mortgage its real and personal property; to issue bonds or debentures sccured by mortgage or otherwise; to sign bills, notes, contracts or other evidences of or securities for money borrowed or to be borrowed for the purposes aforesaid; and to pledge debentures as security for temporary loans, and to keep debentures alive for the purpose of reissue; or to reissue debentures after redemption thereof.

8. For the purpose of acquiring capital to carry on the said businesses the association may from time to time create

and issue bonds or debentures in such denominations and amounts as to the association shall seem advisable, giving the same such preference and priority as respects interest or capital and such rights to participate in the profits of the association as the resolution of the executive of the association authorising the issue thereof shall determine, and such control over the affairs of the association and right to participate in the management as may be considered expedient, provided, however, that the issue, sale, or subsequent transfer thereof shall be limited to members of the association, to all associations incorporated under The Agricultural Co-operative Associations Act, and to members or shareholders of such inentioned corporations and to any company, corporation or association which has enrolled its shareholders as members of The Saskatchewan Grain Growers' Association.

"9.
