IN THE CITY OF PERTH.

A way delineated on plan 672 deposited in the Office of Titles, and being portion of Town Lot N147, abutting on the West side of Lots 9 and 36, and lying in part between the South boundary of Lots 9 and 10 and the North boundaries of Lots 35 and 36; ways on the East side of Lot 13 and Lot 35 being substituted therefor.

IN THE MUNICIPALITY OF BUNBURY.

The whole of a 20 link Way lying between the Western boundaries of Lots 30 to 35 inclusive, and the Eastern boundaries of Lots 19 to 24 inclusive, in the subdivision of part of Lot 73 of Leschenault Location 26, as shown on Deposited Plan 1662 in the Lands Titles Office.

IN THE MUNICIPALITY OF ALBANY.

All that portion of Rowley Road extending Eastward from the prolongation North-Eastward of the South-Eastern boundary of Albany Lot 353, to the Western side of Suffolk Street.

IN THE MUNICIPALITY OF CUE.

All that portion of Post Office Street at its intersection with Austin Street, bounded by lines starting from the West corner of Lot 330 (as surveyed), and ext nding 30 degrees 57 minutes 6 9/10 links; thence 153 degrees 28 minutes 13 links; and thence 301 degrees 9 minutes 11 links to the starting point; also that portion of Post Office Street bounded by lines starting from the South-East corner of Lot 330 (as surveyed), and extending 49 degrees 52 minutes 9 3 /10 links ; thence 319 degrees 52 minutes 55 6/10 links ; thence 229 degrees 52 minutes 31 7/10 links; and thence 117 degrees 56 minutes to the starting point.

IN THE MUNICIPALITY OF GERALDTON.

All that portion of a 75 link road bounded on the North by the South boundaries of Geraldton Lots 332 and 339; and on the South by the North boundary of Sub. Lot A.

All that portion of Crowther Street bounded by lines starting from the intersection of its West side with the South side of Augustus Street and extending 89 degrees 2 minutes 23 links; thence 179 degrees 2 minutes 2 chains 68 7/10 linksto its Western side aforesaid, and along it Northward to the starting point, as shown on Diagram G.638 in the Department of Lands and Surveys.

AN ACT to further amend the Agricultural Bank Act, 1906.

E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Agricultural Bank Act Amend- Short title. ment Act, 1913, and shall be read as one with the Agricultural Bank Act, 1906, hereinafter referred to as the principal Act.

2. Section sixteen of the principal Act, as amended by the Amendment of Agricultural Bank Act Amendment Act, 1912, is further amended Section 16. by striking out the words "three million five hundred thousand pounds," and inserting in place thereof "four million pounds."

AN ACT to empower the Municipality of Fremantle to acquire, use, and dispose of certain lands within the Municipal District for the Benefit and Improvement of the Town.

E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:--

1. This Act may be cited as the Fremantle Improvement Act, Short title.

First Schedule.

2. On a day to be fixed by proclamation the lands described Vesting of lands in in the First Schedule and delineated in the plan therein shall by Municipality. force of this Act vest in the Municipality for an estate in fee simple in possession freed and discharged from all trusts, mortgages, charges, obligations, estates, interests, rights-of-way, and other easements whatsoever, and the Registrar of Titles shall, on demand of the Municipality and on payment of the proper fees, issue to such Municipality a Certificate of Title to the said lands in accordance with this Act.

Compensation.

(a.) That neither the date of the issue of the proclamation nor the day fixed thereby shall be earlier than two months or later than twelve months after the commencement of this Act, and

(b.) That no such proclamation shall be issued at all if the acquisition of the said lands is disapproved by a majority of the ratepayers voting on the question under the provisions hereinafter contained.

3. (1.) The estate and interest of every person in any of such lands, whether legal or equitable, shall be converted into a claim for compensation.

(2.) Such compensation shall be determined in manner set out in the Public Works Act, 1902: Provided that (subject as hereinafter set out) claims for compensation shall be made and the compensation shall be assessed as if the lands had by notice. published in the Gazette been taken compulsorily under the said Act for a public purpose and vested in the Municipality on the ninth day of September, nineteen hundred and thirteen, and for the purposes of the said Act the lands shall be deemed to have been so taken and vested.

(3.) If the Municipality fails to serve an offer on any claimant for compensation within the time limited by the Public Works Act, 1902, then the Minister may serve an offer on behalf of the Municipality, and such offer shall be deemed to be an offer duly made by the Municipality for the purposes of the said Act.

(4.) Any compensation awarded shall be paid and applied in manner provided in the said Act.

(5.) Notwithstanding anything hereinbefore contained, the Municipality shall not be entitled to any rents and profits of the said lands which have accrued before the proclaimed day; but the rents and profits shall pass to the Municipality as from the vesting of the lands under this Act.

(6.) In lieu of the addition authorised by paragraph d. of section sixty-three of the said Act, interest at the rate of six per centum per annum on the amount of the compensation from the proclaimed day till the date of the award shall be added to the award.

(7.) Notwithstanding anything in this Act or in the Public Works Act, 1902, no machinery affixed to any of the said lands shall be deemed to pass to the Municipality nor shall any allowance be made therefor in assessing the compensation, but such machinery shall as between the Municipality and any person claiming compensation be deemed to be severable from the said land.
