members of the Birmingham Law Society, and attained honorary distinction, the Council have awarded to him the bronze medal of the Birmingham Law Society. Mr. Hodgkinson served his clerkship with Messrs. Smith, Pinsent, and Co., of Birmingham, and obtained a second-class certificate at the honours examination held in April 1896.

STEPHEN HEELIS PRIZE FOR CANDIDATES FROM MANCHESTER OR SALFORD.-Harold Porter Mellor, B.A., from among the candidates from Manchester or Salford, having passed the best examination, and attained honorary distinction, the Council have awarded to him the prize, consisting of a gold medal, founded in memory of the late Mr. Stephen Heelis, of Manchester. Mr. Mellor served his clerkship with Mr. John Ogden, of the firm of Messrs. Diggles and Ogden, of Manchester, and obtained a second-class certificate at the honours examination in January 1896.

MELLERSH PRIZE.-Hugh John Vinall, from among candidates who have been articled in the counties of Surrey or Sussex, or who are the sons of solicitors who have resided or practised in either of those counties, having shown himself best acquainted with the law of real property and the practice of conveyancing, the Council have awarded to him the prize founded by the late Mr. Robert Edmund Mellersh, of Godalming. Mr. Vinall served his clerkship with Mr. Isaac Vinall, of Lewes, and obtained a second-class certificate at the honours examination held in November 1896.

COUNCIL OF LEGAL EDUCATION.-EASTER PASS EXAMINATION 1897.

EXAMINATION OF CANDIDATES FOR PASS CERTIFICATES. THE attention of students is requested to the following rules :

No student shall receive from the council the certificate of fitness for call to the Bar required by the four Inns of Court, unless he shall have passed a satisfactory examination as follows:

Candidates will be examined in the following subjects, in addition to Roman Law: 1. Law of Real and Personal Property; 2. Law of Contracts and Torts; 3. Principles of Equity; 4. Evidence, Procedure, and Criminal Law; 5. Constitutional Law and Legal History. Students have the option of passing the examination in the subject of Roman Law, and in the subject of Constitutional Law and Legal History, or in either of such subjects separately from other subjects. Students exercising this option must present themselves for examination in Roman Law and Constitutional Law and Legal History before the other subjects.

Students who present themselves for examination and whose papers show that they had no reasonable expectation of passing may be ordered not to be admitted for examination again until the expiration of such time as the council may direct.

A student who, at any time previously to his admission at an Inn of Court, was a solicitor in practice for not less than five consecutive years, either in England or in any colony or dependency, but who in either case was admitted in England, and in accordance with rule 7 of the consolidated regulations has ceased to be a solicitor before his admission as a student, may be examined for call to the Bar without keeping any terms, and may be called to the Bar upon passing the public examination required by these rules, without keeping any terms; provided that such solicitor has given at least twelve months' notice in writing to each of the four Inns of Court, and to the Incorporated Law Society, of his intention to seek call to the Bar, and produces a certificate that he is a fit and proper person to be called to the Bar, signed, if his practice was in England, by two members of the council of the Incorporated Law Society, and, if his practice was in a colony or dependency, by the Chief Justice of such colony or dependency.

The council may accept as an equivalent for the examination in Roman Law (1) A degree granted by any university within the British Dominions, for which the qualifying examination included Roman Law; (2) A certificate that any student has passed any such examination, though he may not have taken the degree for which such examination qualifies him; and (3) The testamur of the public examiners for the degree of Civil Law at Oxford that the student has passed the necessary examination for the degree of Bachelor of Civil Law; provided the council is satisfied that the student, before he obtained his degree, or obtained such certificate or testamur, passed a sufficient examination in Roman Law.

An examination will be held in April next, to which a student of any of the Inns of Court who is desirous of becoming a candidate for a certificate of fitness for being called to the Bar, or of passing the examination in Roman Law Constitutional Law and Legal History, will be admissible. Each student proposing to submit himself for examination will be required to enter his name in full, personally or by letter, at the treasurer's or steward's office of the Inn of Court to which he belongs, on or before Monday, the 29th day of March next; and he will further be required to state in writing whether his object in offering himself for examination is to obtain a certificate preliminary to a call to the bar, or whether he is merely desirous of passing the examination in Roman Law and Constitutional Law and Legal History under the above-stated rule.

The examination will commence on Tuesday, the 6th day of April next, and will be continued on the Wednesday and Thursday following. It will take place in the Inner Temple Hall, and the doors will be closed ten minutes after the time appointed for the commencement of the examination.

The examination by printed questions will be conducted in the following order :-Tuesday morning, 6th April, at ten, on the Law of Real and Personal Property and Conveyancing. Tuesday afternoon, 6th April, at two, on Law and Equity, first paper. Wednesday morning, 7th April, at ten, on Law and Equity, second paper. Wednesday afternoon, 7th April, at two, on Evidence, Procedure, and Criminal Law. Thursday morning,

8th April, at ten, on Roman Law. Thursday afternoon, 8th April, at two, on Constitutional Law and Legal History.

The Oral Examination will be conducted in the same order, and at the same hours, as above appointed for the examination by printed questions. The Examiners in the Law of Real and Personal Property and Conveyancing will examine in the following subjects:-Elements of the Law of Real and Personal Property-Vendors and Purchasers of Land-Settlements and Wills.

The Examiners in Law and Equity will examine in the following subjects: First paper: Elements of the Law of Contracts and TortsNegotiable Instruments-Agency in Mercantile Contracts-Contracts of Sale of Goods. Second paper: Trusts-Specific Performance-Mortgages and other Securities-Administration of Assets.

The Examiners in Roman Law will examine in the following subjects:1. Law of Persons-Slavery; Patria Potestas; Husband and Wife: Tutela; Cura. 2. Law of Property-Dominium; Possessio; Servitudes, personal and prædial; Emphyteusis; Mortgage. 3. Law of ContractFormal Contracts; Contracts re; Contracts for valuable consideration in Correality; Accessory Contracts; Fidejussio; Mandatum money; Pecunia Constituta; Elements common to all contracts. 4. Delicts. 5. Wills, Legacies, and Trusts.

The Examiners in Constitutional Law and Legal History will examine in the following subjects:-1. Constitutional Law: (1) The Crown and the Executive; (2) The Law and Custom of Parliament. 2. Legal History. 3. The Constitutional History of England.

The Examiners in Evidence, Procedure, Civil and Criminal, and Criminal Law will examine in the following subjects:-The Elements of Procedure, Civil and Criminal-The Elements of Evidence-Criminal Law.

The above subjects will be examined upon so far only as treated in the lectures and classes since Hilary Term 1895.

The awards upon the Easter Pass Examination will be published at the office of the Council, Lincoln's-inn Hall, on Tuesday, the 27th April, at 5.30 p.m.

NOTE. The Trinity Pass Examination will be held in Lincoln's-inn Hall, the 31st May, 1st and 2nd June. Last day for entry of names, Monday, the 24th May.

STUDENTS' SOCIETIES.

LAW STUDENTS' DEBATING SOCIETY.-The usual weekly meeting of the above society was held at the Law Institution, Chancery-lane, on Tuesday, the 26th inst.; chairman, Mr. A. Hair. The subject for debate was: "That the case of Elgood v. Harris (1896) 2 Q. B. 401) was wrongly decided." Mr. T. Douglas opened in the affirmative, and Mr. R. H. Armstrong seconded; Mr. Nimmo opened in the negative, and Mr. Burn seconded. The following members also spoke: Messrs. Daniell, W. H. Jones, Vickers, H. Fox, W. Hudson, N. Tebbutt, A. E. Clarke.-The subject for debate at the next meeting of the society on Tuesday, the 2nd Feb., is: "That, having regard to the report of the commission upon the financial relations between Great Britain and Ireland, the rectification of the inequality in the contributions of Ireland to the Imperial Exchequer should be undertaken forthwith."

BURNLEY AND DISTRICT.-On Thursday, the 21st Jan., the members of this society met in Cronkshaw's Hotel for the first time since the Christmas Vacation. The chair was taken by Mr. J. C. Waddington, and the subject for discussion was the January Law Notes moot: "A., owner and in possession of Whiteacre, verbally lets to B. 'all shooting rights' over Whiteacre at £50 a year. B., under the contract, enters upon the property and exercises his right of shooting. Shortly afterwards A. lets Whiteacre to C., a farmer, without consulting B. C. proceeds to shoot the ground game under the Act of 1880. B. complains to A. that, after letting all the shooting rights to him, he had no business to let the farm to C., and, as B. took the shooting more particularly for the ground game, he brings an action against A. for breach of contract. A. pleads (1) that a right to shoot cannot arise without a deed; (2) that even assuming that a deed is not necessary, at any rate, by virtue of sect. 4 of the Statute of Frauds, the verbal contract did not bind him; (3) that even assuming the verbal contract, followed by entry, to have been binding, he (A.) had a perfect right to let the farm to C., as the contract with B. was made upon the implied understanding that A. was to have the right to let the lands for agricultural purposes, which letting would, under the Ground Game Act, 1880, carry with it the right, concurrently with B.'s rights, to shoot the ground game. B. joins issue in these defences. What will be the result

of the action?"-Mr. J. K. Pickup (hon. sec.) argued that, on the authority of Webber v. Lee, the grant of a right to shoot over land and to take away a part of the game killed was a grant of an interest in land and within the Statute of Frauds. Sect. 4 of that statute says that any grant of such interest must be in writing and signed by the party to be bound or his duly authorised agent. But the court will enforce specific performance of a contract within the statute where the parol agreement has been partly carried into execution by the party praying relief, and this upon the ground that otherwise one party would be able to practise a fraud upon the other, contrary to the intention of the statute; therefore, where one party has executed his part of the agreement in the confidence that the other party will do the same, and it would be a fraud upon the former to suffer the latter to escape from the performance of his part of the agreement, equity will decree specific performance. He cited Lester v. Foxcroft (1 Coll. P.C. 108) to prove that a contract which could not be enforced because not in writing may become enforceable in equity by reason of one party allowing the other to partly perform it. The object of sect. 4 was not to alter principles of law but modes of evidence. It is fraud to allow part performance under the section and then turn round and say "You have no

case, I never set my hand to writing." The statute shall not be made an engine of fraud. Subsequent impossibility is no excuse, and therefore B. was entitled to recover quantum meruit damages from A. for breach of contract. Mr. Pickup was supported by Mr. J. C. Pollard, solicitor. Mr. T. G. Sandy, jun. (solicitor) in arguing for the negative said that as an incorporeal hereditament unannexed to the freehold it required a deed, and quoted from Woodfall's Landlord and Tenant. He also argued on the first point that it was a profit à prendre and required a deed on that account under sect. 4 of the Statute of Frauds, it being an interest in land, the amount of rent presupposing that the game was to be carried off the land; and cited from Woodfall, and Bird v. Higginson, Adams v. Clutterbuck and Webber v. Lee. On the last point he argued that there was no covenant prohibiting the leasing of the farm, no such covenant could be implied, that the landlord's right of managing his estate was not taken away by the grant of the shooting right. There was no part performance of a right to enter on land, there was no example of it. The Game Act was part of the contract if contract there was, it could not be excepted. Precisely the same events would have occurred if there had been a deed. If the plaintiff had suffered through his mistake it was his own fault through not obtaining proper advice. His right to shoot was not taken away, he had a concurrent right. Mr. Sandy was supported by Messrs. J. Bracewell, T. B. Nowell, A. Riley, F. Roberts, and W. F. Sutcliffe. Mr. J. C. Waddington then called on the leaders to reply after which he delivered a well-prepared judgment. The meeting decided in the negative by a majority of four.

MANCHESTER.-The sixth meeting of the session was held on Tuesday, the 19th inst., in the Law Library, under the presidency of Prof. Copinger LL.D. Mr. H. Williamson (one of the hon. secs.) announced the society's success in the "Law Notes" moot competition, the prize having been won by the society. Mr. C. T. Tallent-Bateman, solicitor, then gave a lecture on "The law and practice relating to chief rent charges. and particularly to the covenants and powers for their recovery and security." Several solicitors attended and a considerable number of law students. The lecturer pointed out the peculiar nature of the Manchester "chief rents (inaccurately so-called, they being technically "rentcharges "), and noted that the only law writers who had dealt specially with the subject were Manchester men, namely, Mr. William Harrison, Dr. Copinger (the chairman), and the late Prof. Munroe. After dealing with the important questions, as to how far certain protective covenants "run with the land," and how far some of the usual powers and covenants inserted in deeds to secure or protect chief rents were legally binding, distinguishing between positive and affirmative cevenants and negative or restrictive covenants and showing that these two classes were subject to distinct rules of law, Mr. Tallent-Bateman reviewed in detail an article appearing in a professional journal (the LAW TIMES) some months ago, which threw doubts on several familiar remedies with regard to chief rents, the gloomy tone of which article he (the lecturer) thought was unwarranted. Finally, he dealt at length with the powers and remedies which should be offered to a purchaser of land by way of indemnity against an overriding rent which it is not intended such purchaser should have to pay. At the close of the lecture some discussion ensued which was very ably summed up and commented on by the Chairman. In the course of a vote of thanks to the lecturer it was urged upon him that he should allow his valuable lecture to be printed, and arrangements will probably be made by the society in that behalf.

NEWCASTLE-UPON-TYNE.-The ninth general meeting of the society was held on Wednesday, the 20th Jan., in the Law Library; Mr. W. C. J. Shortt in the chair. Mr. J. Grant Gibson, barrister-at-law, Official Receiver, was elected an honorary member. The subject of debate was the January Law Notes moot (see BURNLEY AND DISTRICT, above). Messrs. T. R. Ramsay and F. D. Bruce opened for the plaintiff, and Messrs. L. Booth and A. B. Lemon for the defendant. When the debate was declared open, the following also spoke: Messrs. E. C. Sanders, G. W. Chapman, W. H. Ord, J. Winn, R. E. B. Lisle, and C. S. Hadaway, and after the opener had replied, the Chairman gave an exhaustive summing up, and first put this motion, "Was B.'s right of action barred by reason of technical grounds?" which was decided by a majority of twelve in the negative; and secondly, "Would the plaintiff succeed in his action?" when there was a majority of five in the negative.

LEGAL OBITUARY.

Mr. EDWIN MORCOM HARWOOD, senior partner in the firm of Messrs. Harwood and Boutflower, solicitors, of Bristol, died on the 10th inst. at his residence, Langport House, Montpelier. The deceased filled the office of deputy to the late coroner for Bristol, Mr. H. S. Wasbrough, for many years. He was admitted a solicitor in 1848, and was a member of the Incorporated Law Society and the Solicitors' Benevolent Association The deceased, who was about seventy years of age, leaves a widow and three daughters.

ORDER UNDER THE STANNARIES COURT (ABOLITION) ACT 1896. DATED DECEMBER 16, 1896.

I, HARDINGE STANLEY, BARON HALSBURY, Lord High Chancellor of Great Britain, by virtue of the Stannaries Court (Abolition) Act 1896, and all other powers enabling me in that behalf, do hereby order as follows:

1. The County Courts of Cornwall shall be the Courts to and in which the jurisdiction and powers of the Stannaries Court are by the said Act transferred and vested.

2. Anything required to be done by, to, or before the registrar or any clerk of the Stannaries Court shall be done by, to, or before the registrar or any clerk of any of the County Courts aforesaid.

3. All proceedings pending in the Stannaries Court at the commencement of the Act shall be transferred to the County Court held at Truro, to be there completed in the same manner as if the said Act had not passed.

4. The place of sitting for the exercise of any of the jurisdiction(1) of the judge shall be at Truro, unless in any case he shall, on the ground that some other place will be more convenient for the suitors, otherwise direct;

(2) of the registrar shall be at the court where the proceedings shall have been commenced, unless in any case the judge shall, for the convenience of parties, otherwise direct.

5. Notwithstanding anything in these Rules, the jurisdiction and powers of the Stannaries Court in regard to the winding-up of companies, and to all cases where the subject-matter is not within the limits of the County Court jurisdiction, shall be exclusively exercised by the Court having bankruptcy jurisdiction in Cornwall.

6. The property, rooms, and building mentioned in section 1 (2) (d) of the Act shall be used and disposed of as may be agreed upon between the judge of the County Courts of Cornwall and the corporation of Truro, subject to the approval of the Lord Chancellor.

7. Arrangements for the custody of the records in the same section mentioned shall be made by the corporation of Truro, in consultation with the judge of the County Court, subject to the approval of the Lord Chancellor.

8. This Order shall come into operation on the 1st of January 1897. The sixteenth day of December 1896.
