The Law and the Lawyers.

MR. ATHERLEY JONES, Q.C., M.P., has obtained a conditional promise from Mr. BALFOUR of a day for his motion for a Royal Commission to inquire into the working of the Judicature Acts. It is believed to be possible that he will receive support from other lawyers, and prominently from Mr. COZENS-HARDY, Q.C., M.P., who, as a member of the Rule Committee and chairman of the General Council of the Bar, would carry great weight.

THE new rules for which the Profession have long been looking are expected to come forward in detachments. They present to the Rule Committee a labour which must extend over a very long period. As prepared they will be submitted to the Bar Council and the Council of the Incorporated Law Society before being published in the Gazette.

THE Hardwicke Society, at its meeting last week, passed unanimously a resolution that the constitution and procedure of our Common Law Courts require amendment.

A HUMORIST among the debaters gave a new reading of the maxim, "Interest reipublicæ ut sit finis litium." Rightly or wrongly, he attributed to many of the judges the view that this means, not an end of a cause, that is, finality, but a cessation of all litigation.

FOR the time being the projected Bar Club is dropped by the Bar Council. The probability is that it will be brought forward at the annual meeting of the Bar in April. The scheme receives little favour from the Benchers of the Inns of Court, who regard it as a first step towards concentration. So it is. And so it ought to be.

THE Court of Appeal has decided this week that, where money is paid into court before defence, a subsequent stateWe shall deal ment of defence denying liability is bad. with this important decision next week. It throws some light upon the rule against communicating the fact of payment into court to the jury. The whole subject must soon. receive re-consideration.

MR. CURZON's refusal to lay upon the table of the House of Commons "communications" which he stated in debate were made to the Government by the Italian Government, "repeatedly requesting" the Government to aid Italy by a forward movement in the Soudan, was supported subsequently by the SPEAKER when the matter was brought under his notice on somewhat technical grounds. A Minister of the Crown, or one representing him in the House of Commons, is not, in accordance with an admitted principle of debate, at liberty to read from, or quote from, a despatch or other State paper not before the House, unless he is prepared to lay it This restraint is, according to Sir the table. upon ERSKINE MAY, similar to that rule of evidence in courts of law which precludes counsel from citing documents which have not been produced in evidence: (May's Parliamentary Practice, p. 340). When Sir WILLIAM HARCOURT, immediately on Mr. CURZON's reference to these communications, demanded their production, Mr. CURZON sheltered himself

THE SPEAKER ruled that a Minister who says generally that he has had communications from a Government, is not bound to produce every document, and that there is a distinction between specifically referring to documents generally and specifically referring to an individual document. The effect of this ruling seems to be that, if a single document had been specifically referred to, it would have been necessary, in accordance with the rules of debate, to produce it; but when there are a number of documents in this category, the rule does not prevail. The distinction between the rule of evidence and the rule of debate, already sufficiently wide, becomes thus wider. We have said that the distinction is already sufficiently wide, inasmuch as the rule of debate requiring the production of documents when quoted is only applicable in the case of Ministers of the Crown or their representatives. It does not apply to members not connected with the Government, who can cite documents in their possession, both public and private, without placing themselves under any obligation for their production. The non-production of documents once cited, whether by Ministers of the Crown or by private members, subjects statements in reference to them to this drawback, which, on the 25th Aug. 1887, was accurately explained by Mr. Speaker PEEL: “If a Minister (or a private member) declines to lay upon the table documents, it so much diminishes the authority they carry, inasmuch as the House cannot judge for itself of their value."

THE Marine Insurance Bill has been again introduced by Lord HERSCHELL. It is drawn on the same lines as the Bills of Exchange Act 1882, and the Sale of Goods Act 1893, and endeavours," as stated in the prefatory memorandum, "to reproduce as exactly as possible the existing laws relating to marine insurance, leaving any substantial amendments that may seem desirable to be introduced by the Legislature at a later stage." Since the Bill was originally introduced in 1894, its provisions, together with suggestions received from various sources, have been carefully considered by a committee consisting of representatives of shipowners, average adjusters, and underwriters, so that it may be considered to reproduce the existing law with as exact accuracy as is attainable. There are ninety-four clauses and three schedules, the first schedule containing rules of great importance" for construction of policy," prescribing, for instance, that "'fire' does not cover a loss caused by the explosion of steam, nor a fire caused by the inherent vice of the subject-matter insured, but covers a fire voluntarily caused in order to avoid capture by an enemy." Only three Acts are proposed for repeal and re-enactment-the Insurance Act 1745 (19 Geo. 2, c. 37), which applies to all kinds of insurance, and is only to be repealed as respects marine insurance; the Marine Insurance Act 1788 (28 Geo. 3, c. 56), by which contracts, "interest or no interest," and wagering contracts of marine insurance are void; and the Policies of Marine Insurance Act 1867 (31 & 32 Vict. c. 68), by which the assignee of a policy may sue in his own name-by far the greater part of marine insurance law being case law.

THE Truck Act 1896 (59 & 60 Vict. c. 44) is credited with having contributed to the unexpected result of the Walthamstow election. Passed, as all previous Truck Acts have been, in the interest of workmen, it is difficult at first sight to discover how the Act could have come to have this effect. But the explanation appears to be this: The Act, in order to

protect the workman from unexpected fines, directs that no contract for deduction of fines from wages shall be made unless "the terms of the contract are contained in a notice kept constantly affixed at such place or places open to the workman, and in such a position that it may be easily seen, read, and copied by any person whom it affects," or "the contract is in writing signed by the workman," with many other particulars as to reasonableness of fines and other matters. Of the two alternatives, publication and specially signed contract, by far the majority of the employers of labour have chosen the former mode of legitimising their contracts for deduction of fines from wages, with the result that hundreds and thousands of workmen have for the first time fully realised the existence and the amounts of fines to which they have long been subject, and have drawn the inference that if it had not been for the Act they would not have been liable to the fines at all. They appear quite to overlook the fact that fines are no new thing, and that if it had not been for the Act it would have been very difficult to resist arbitrary fines, whereas the Act enacts that fines are not to be contracted for unless they are in respect of some act or omission which causes, or is likely to cause, damage or loss to the employer, or interruption or hindrance to his business, and “the amount of the fine is fair and reasonable, having regard to all the circumstances of the case."

A CASE of great interest and importance to solicitors has been decided in the Court of Appeal with reference to the General Order made under the Solicitors' Remuneration Act 1881. In Re McGarel (a Lunatic) the master in lunacy directed the lunatic's committee in 1887 to take a house on a seven years' lease for the occupation of the lunatic at the yearly rental of £350. They accordingly did so, and paid to the lessor's solicitor the sum of £13 15s., being £7 10s. for the first £100 of rent, £2 10s. for the second £100, £2 10s. for the third £100, and £1 5s. for the remaining £50. A sum equal to half this amount was paid to the committee's own solicitor. In 1894 the lease was renewed for another seven years, and the same sums were paid to the lessor's and committee's solicitors respectively. On taking in the items. for taxation in the lunacy, in order to charge the lunatic's estate with them, the taxing master disallowed in both cases the sum paid for the £50 above the £300, holding that the payment was not authorised by the schedule to the General Order. The Court of Appeal upheld the decision of the taxing master. By Schedule I., Part II., of the General Order the lessor's solicitor, for preparing, settling, and completing lease and counterpart, where the rent does not exceed £100, is to receive £7 10s. per cent on the rental, but not in any case less than £5, and, where the rent exceeds £100, but does not exceed £500, £7 10s. in respect of the first £100 of rent, and £2 10s. in respect of each subsequent £100 of rent. The lessee's solicitor, for perusing draft and completing, is to have one half of the amount payable to the lessor's solicitor. By rule 6 of the rules applicable to Schedule I., Part II., fractions of £5 are to be reckoned as £5. The decision of the Court of Appeal seems perfectly right, for, as they pointed out, they could not have come to any other decision without altering the phraseology of the rule. As to the first £100, it is clear that the schedule allows a percentage, but, as to the next and succeeding hundreds, the words "per cent." are omitted, and, as Lord Justice LINDLEY says, "no doubt, intentionally." Rule 6 is quite intelligible, for it would apply to all cases between £65 and £100 where the scale of remuneration would exceed the minimum of £5 and would not reach £7 10s. There is no doubt that the rules in these schedules have not been considered in this light in a great number of cases, and this decision, calling attention to the true and proper construction of this part of the General Order, will affect a great number of the Legal Profession.
