LAW SOCIETIES.

HARDWICKE SOCIETY.

THE weekly meeting was held in the Inner Temple Lecture-hall, King's Bench-walk, on Friday, the 26th Feb., at eight o'clock. Mr. H. N. Ferrers moved, and Mr. Walter C. Copeland opposed the following resolution: "That Mr. Cecil J. Rhodes ought to be impeached." The debate was adjourned till the following week.

UNITED LAW SOCIETY.

ON Monday, the 1st inst., Mr. C. W. Williams in the chair, Mr. W. J. Boycott opened a debate on the motion "That Greece should be allowed to deal with Crete without interference from the powers." Mr. J. R. Yates opposed, and the debate was continued by Dr. C. Herbert Smith and Messrs. A. M. Begg, A. H. Richardson, C. Kains-Jackson and W. F. Symonds. Mr, Boycott then replied, and on the motion being put to the vote it was carried by a majority of two votes.

UNION SOCIETY OF LONDON.

THE Society met at the Inner Temple Lecture-hall on Wednesday evening, the 3rd inst.; Mr. J. Arthur Price, president, in the chair. After the reading of the minutes and the disposal of private business Mr. W. V. Ball brought forward the motion on the agenda paper viz.: "That in the opinion of this House, State control should be exercised over the export of the natural product of the country." Speakers: for the motion, Messrs. Ball, Kinipple, Lyons and'Arnold; against, Messrs. Copeland, Sibley, Withers, Bruce, Willson, and Jenks. The motion was lost. The society will meet at the Inner Temple Lecture-hall, 3, (North) King's Bench-walk, on Wednesday evenings, March 10, 17 and 24, at eight o'clock. Subjects for debate: For March 10: "That at the ceremony of episcopal confirmations, the refusal to hear objections is justifiable neither by law or policy;" opener, Mr. J. Arthur Price. For March 17: "That it is essential to the well-being of the country that the Liberal and Labour Parties should combine; Mr. V. Lyons. For March 24: "That in the opinion of this House, a written constitution is the sole effective guarantee of the liberty of the press; opener, Mr. H. W. Sibley.

CORRESPONDENCE.

QUEEN'S DIAMOND JUBILEE.-I understand that the Council of the Incorporated Law Society are now considering by what means the Queen's Diamond Jubilee shall be celebrated so far as our branch of the Profession is concerned. May I venture to suggest that the year may be marked in the history of the society by the council taking the necessary steps to obtain authority to change its name or style from "Incorporated," to Royal." The many duties now performed by the society by authority from the Crown in connection with solicitors as officers of Her Majesty's Courts of Justice, give the society a strong claim to the prefix of "Royal," and I venture to think that the change would not only be a popular one in the profession, but could not fail to add dignity to the society. I should also be glad to see our society or institution known as the "Royal College of Law," it is to my mind quite as much entitled to be styled a "College" as its neighbour the Royal College of Surgeons. Moreover, could we not take a leaf out of our neighbour's book and have Members and Fellows.

COMMERCIAL FAILURES AND BILLS OF SALE.-According to Stubbs' Weekly Gazette, the number of failures in England and Wales gazetted during the week ending the 27th Feb. was 147. The number in the corresponding week of last year was 159, showing an increase of 12. The number of bills of sale in England and Wales registered at the Queen's Bench for the week ending the 27th Feb. was 158. The number in the corresponding week of last year was 182.

27. INTESTATE AND NO NEXT OF KIN.-Would any of your readers kindly refer me to any instances where the Crown, having claimed half a husband's personalty, by reason of his having died intestate leaving a widow but no next of kin, it has, after making every inquiry for next of kin (without result) and waiting a reasonable time, released the fund in its hands to the widow or to her poor relations upon their petition? I am told that there have been many such cases. SIDNEY NEWMAN.

(Q. 22.) MARRIED WOMEN MORTGAGEES OF FREEHOLDS.-It is submitted that a married woman who is a mortgagee of freeholds ought to convey by deeds acknowledged with the concurrence of her husband. The reasons given in support of the judgment in Re Harkness and Allsop's Contract (74 L. T. Rep. 652) apply with almost equal force to the above proposition. The judgment is based on the fact that the Married Women's Property Act 1882 deals with a married woman's own property; i.e., it must be her property in the ordinary sense of the word. Now, the mortgagor is, until foreclosure, the real owner of the land and possessed of it in his ancient and original right and estate: (see Coote, 5th edit., p. 31; Casborne v. Scarfe, 1 Atk. 602). The mortgagee has merely the legal estate, and not the beneficial interest. Another reason for the proposition is, that the Act makes a married woman's property liable for her debts. As the estate of the mortgagee in the land is never liable for his debts, it is not conceivable that the Act is intended to alter the law in this respect as regards married women mortgagees only. Mr. WILLIAM WILLIS, Q.C., has been appointed Judge of the County Court Circuit No. 32, in the place of his Honour Judge Addison, transferred to Southwark.

Mr. EDWARD WINGFIELD, C.B., has been appointed Permanent UnderSecretary of State in the Colonial Department, in succession to the Hon. Sir R. H. Meade, K.C.B., who is about to retire on the ground of his health.

Mr. CHAS. WM. REES STOKES, solicitor, Tenby, has been appointed Undersheriff for Pembrokeshire.

Mr. THOS. J. RICHARDS, of the firm of Perry, Son, and Richards, rolicitors, Birmingham, has been appointed a Commissioner for Oaths. Mr. Richards was admitted in Nov. 1890.

The Council have given class certificates to the candidates in the second and third classes.

STUDENTS' SOCIETIES.

LAW STUDENTS' DEBATING SOCIETY.-The usual weekly meeting of the above society was held at the Law Institution, Chancery-lane, on Tuesday, the 2nd inst; chairman, Mr. J. S. Wilkinson. The subject for debate was: "That, in view of recent events, it is desirable that this country should take the first suitable opportunity of withdrawing from the Concert of Europe." Mr. C. Herbert-Smith opened in the affirmative; and Mr. Rupert Blagden opened in the negative. The following members also spoke: Messrs. W. H. Jones, D. Nimmo, G. H. Daniell, J. D. A. Johnson, A. E. Clarke, C. H. Head, H. Hamilton Fox, L. W. Bangley, and G. R. Reed. The motion was lost by four votes.-The subject for debate at the next meeting of the society, on Tuesday, the 9th March, is "That the case of Engelhart v. Farrant and Co. (75 L. T. Rep. 617; (1897) 1 Q. B. 240) was wrongly decided.

BRADFORD.-A meeting of this society was held at the West Riding Court on Wednesday the 24th ult., Mr. E. W. Perkins presiding. The subject for debate was, "That the case of Reg. v. Ashwell was wrongly decided" (16 Q. B. Div. 190). Mr. J. W. Perkins opened the debate on behalf of the affirmative, being supported by Mr. H. Dumaine. Mr. J. W. Barraclough opposed on behalf of the negative, and was seconded by Mr. W. Dunn. On the debate being thrown open Messrs. Gregory, Suddards, Purnell, Turnbull, Firth, and Hammond also spoke. The Chairman ably summed up the arguments adduced, and addressed the members upon the law of possession. On a vote being taken it was found that the negative were successful by a majority of eight, one member not voting.

DEWSBURY, WAKEFIELD, AND DISTRICT.-An ordinary meeting was held in the Law Library, Dewsbury on the 24th Feb.; Mr. C. E. Walker in the chair. There were also present: Messrs. S. A. R. Preston, H. J. B. Wadsworth, A. E. Greaves, C. E. Peace, N. N. Shaw, W. H. Kingswell, T. Catterall, F. C. Hodgson, H. W. Crouch, and H. Pickles (hon. sec.). The subject for the evening was a debate on the following: "A celebrated impersonator and mimic goes to the Derby made up as a certain distinguished statesman and in that character is charged with and convicted of being drunk and disorderly. The case is reported in the newspapers as though the person convicted was the statesman. An action for damages is brought by the statesman against the impersonator. Is he entitled to damages?" Mr. S. A. R. Preston opened in the affirmative; and Mr. H. J. B. Wadsworth followed in the negative. The following also spoke; Messrs. W. H. Kingswell, C. E. Peace, A. E. Greaves, and F. C. Hodgson. After the leaders had replied the Chairman summed up, and on the question being put to the vote it was decided in the affirmative by seven votes to two.

MANCHESTER.-The eighth ordinary meeting of the session was held on Tuesday, the 23rd ult., when the chair was taken by Mr. R. A. Edgar, solicitor. Mr. A. de Clifton Parmiter was elected a member of the society.

After considerable private business, a debate was opened on the ollowing lines: "A., a cyclist, rides down a steep hill with care, at the bottom of which is a confectioner's shop with a large plate-glass window. Just as he is about to turn the corner of the hill, a horse and cart come suddenly into view, and A. being unable to turn, is thrown through the window, which is insured. Can the insurance Mr. G. Buckley, for company successfully bring an action against A. ?" the affirmative, submitted that the defendant A. had set up a dangerous state of affairs and was therefore liable for all its natural consequences (citing Fletcher v. Ryland); that in riding a bicycle he ought to show reasonable competence and failed to do so (citing Jones v. Bird); that the advent of the horse and cart was no ground of excuse for A.'s default (citing Mills v. Armstrong and Clarke v. Chambers); and lastly that, according to Scott v. The London Dock Company, the burden of proof lay on the defendant to show he used proper care both coming down the hill and when the accident occurred. Mr. Z. M. Lord, in reply, argued that the words "with care implied with reasonable care under the circumstances, and that, as nothing as tɔ skill was mentioned, the bicyclist must be presumed to be reasonably skilful. Under these circumstances he maintained that the breaking of the glass was an inevitable accident, and that therefore no action would lie (citing Holmes v. Mather and Stanley v. Powell). A very interesting debate ensued, in which Messrs. H. D. Judson, F. Preston, H. Bury, F. W. Lowndes, L. Wise, and A. Syer, spoke for the affirmative; and Messrs. H. de la Lynde, F. Hindle, W. Booth, F. S. Oppenheim, A. Richardson, C. R. Allen, E. H. Coombs, J. R. Swindells, and F. W. Watson argued in favour of the negative. Mr. Edgar, in summing up, said that the members were there as a jury and must give their verdict on the facts. The words "with care did not necessarily mean "with skill," and it seemed to him very difficult to say that A. rode with sufficient care, as he could not get out of the way of the cart. The meeting finally came to a decision in favour of the insurance company, by a majority of one.

NEWCASTLE-UPON-TYNE. The fifteenth general meeting of the society was held in the Law Library on Wednesday, the 3rd inst.; Mr. H. Temperley in the chair. A lecture on "Some Anomalies in the present Law of Bankruptcy" was given by Mr. J. Grant Gibson, the official receiver. The lecturer dealt with the subject in a most able and exhaustive manner, and among the chief points receiving special attention
