To the Incorporated Law Society is due the credit of a plan for making permanent provision for the necessitous members of the Profession. Masques and Revels are naturally in the contemplation of the Inns of Court. To these there can be no objection. But Benevolence has a claim upon those ancient institutions. Let them emulate the Incorporated Law Society, and if the Barristers' Benevolent Association is not capable of development, let a new Pension Scheme be designed for what is certainly a growing class the aged or crippled and impecunious barrister. A few solicitors have already subscribed over £500. In view of the deadlock so frequently occurring in the Queen's Bench Division-painfully conspicuous during the past week or more-the absolute failure of the Assize system, and the hopelessness of any reform, we have come to the conclusion that the Profession will do wisely to direct its energies to placing County Courts upon a satisfactory footing, with a view to the great bulk of the common law business of the country being done in those tribunals. We give in another column a record of their development, and we shall be glad to receive any suggestions from the Bench and the Profession. We are reversing our former attitude we mean to. THE cases tried in the High Court (Queen's Bench Division) during the present sittings really compare unfavourably with much of the business which is daily disposed of in the County Courts; whilst some High Court judges seem prone to make a sport of the dual system of sittings in town and on circuit. Suitors at Biggleswade, Plymouth, or anywhere else are entitled to enter their causes in London. Why should they be driven to take advantage of the rotten and uncertain assize arrangements, under a penalty of being publicly scouted, or fined in costs disallowed, if they exercise their rights and elect to try in London? Such experiences do much to kill litigation in the High Court. (a) (a) (Before HAWKINS, J. and a Special Jury.) Kitchener and Wife v. The Bedfordshire County Council. During the opening of the proceedings by counsel, HAWKINS, J. asked where Biggleswade was. Counsel In Bedfordshire, my Lord. HAWKINS, J. Is that a place where there are any assizes? Counsel: I think not, my Lord. HAWKINS, J.: I thought there were.. Counsel: Not in Biggleswade. HAWKINS, J.: Oh! no; not in Biggleswade. Counsel having opened the plaintiffs' case, HAWKINS, J. said: How comes this action to be brought here in London? Counsel I suppose because Bedfordshire is so close, and we should have it tried sooner here. HAWKINS, J.: There were assizes there last month. Counsel: My Lord, I am not responsible. HAWKINS, J. It is too bad when the people are crying out for assizes in the country that, when they have got a case that the whole Bar would have danced with joy to have there, it should be set down in London. Counsel: Not the whole Bar, my Lord. In a Devonshire case the same judge refused to certify for a special jury because it was a Devonshire case.
