Mr. CHARLES EDWIN ODGERS, barrister-at-law, has been appointed a Puisne Judge of the Madras High Court, in succession to Sir Abdur Rahim. Mr. Odgers was called by the Middle Temple in 1896. Mr. HAROLD SPENCER MORRIS, M.B.E., K.C., has been appointed Recorder of Folkestone, in place of Sir Lewis Coward, K.C. Mr. Morris was called by the Inner Temple in 1899, and took silk this year.

Mr. F. PERCIVAL EVERS, Solicitor, of the firm of Messrs. Harward and Evers, of Stourbridge, has been appointed Coroner for North Worcestershire, in succession to Mr. Edwin Docker. Mr. Evers was admitted in 1892. Mr. Evers has appointed as his deputy Mr. Geoffrey Ince, who was admitted as a solicitor in July 1920.

Mr. ROLAND GIFFARD OLIVER, barrister-at-law, has been appointed Third Junior Prosecuting Counsel for the Crown at the Central Criminal Court. Mr. Oliver was called by the Inner Temple in 1909.

QUERIES

31. INCREASE OF RENT ACT.-A dwelling-house, situate in a small country town, was let on the 5th Aug. 1914 at £80 a year on a lease which expired in 1918, when the lessee continued on by arrangement as annual tenant at a rent of £60. Notice to quit, to expire at Lady Day next, was given, and the landlord has now given a notice under the above Act to make the following increases in the rent: (1) £20 per annum, to bring the rent up to the standard rent; (2) £12 per annum, under sect. 2 (1) (c) of the Act, being 15 per cent. on the net rent of the premises; (3) £20 under par. (d) on the same sub-section, being 25 per cent. of the net rent. The tenant, under the lease, and subsequently under the annual tenancy, was liable for internal repairs, and has always done them, so that it seems clear that the landlord cannot claim the full 25 per cent. under item No. 3. Can he legally claim items 1 and 2? The reading of the Act as to item No. 2 is so ambiguous that it does not seem clear whether he can charge 15 per cent. or 5 per cent. only. 32. TENANTS IN COMMON-PARTITION. Two freehold houses are vested in A. and B. as tenants in common. A. dies intestate, leaving an infant heir-at-law. It is desired to partition the houses. Has A.'s administrator power to partition? There are other assets sufficient to pay debts, and the proposed partition is not to facilitate a sale for this purpose. N.

33. Re NOTICE TO QUIT AND CLAIM FOR COMPENSATION FOR UNREASONABLE DISTURBANCE.--A client of ours, who is the tenant of a farm under a Lady Day tenancy, was served with a notice to quit before the 25th March 1920 calling upon him to quit his farm on the 25th March 1921, and, in accordance with the provisions of sect. 11 of the Agricultural Holdings Act 1908, he duly served the landlord with a notice of claim for compensation for unreasonable disturbance. Subsequently the Agriculture Act 1920 became operative on the 1st Jan. 1921, and, by the second schedule to the Act. sect. 11 of the Act of 1908 was repealed. Presumably, therefore, this section ceased to be law as on and from the 1st Jan. 1921, and was replaced by sect. 10 of the Act of 1920, the first sub-section of which section reads as follows: "Where the tenancy of a holding terminates after the commencement of this Act by reason of a notice to quit given after the 20th day of May 1920 by the landlord, and in consequence of such notice the tenant quits the holding, then, unless the tenant has been guilty of bad husbandry, or has failed to comply with certain requirements or done other things that are prejudicial to the landlord, or has become bankrupt, or for other reasons stated, "compensation for the disturbance shall be payable by the landlord to the tenant in accordance with the provisions of this section," which provisions immediately follow. It will be observed that in the particular case of our client the notice to quit was given prior to the 20th May 1920. Presumably, therefore, he cannot have recourse to sect. 11 of the Act of 1908, because that section is specifically repealed in the second schedule of the Act of 1920, which came into operation on the 1st Jan. 1921. We should be very interested to know exactly what our client's position is, and whether by the joint operation of sect. 10 and the second schedule of the Act of 1920 he is prevented from recovering compensation for unreasonable disturbance. ANSWERS

(Q. 30.) RENT (RESTRICTIONS) ACT-PUBLIC-HOUSE.-A publichouse is a dwelling-house: (Epsom Grand Stand Association v. Clarke, 35 Times L. Rep. 525). The house in Tompkins v. Rogers (ante, p. 58) was not a public-house. Under the repealed Increase of Rent and Mortgage Interest (Amendment) Act 1919, s. 1 (1), par. (c), the landlord of a public-house might have provided alternative accommodation consisting of a dwelling-house only: (Wilcock v. Booth, 122 L. T. Rep. 678). That case is now inapplicable, as the alternative accommodation must be " reasonably equivalent as regards rent and suitability in all respects": (Rent Act 1920, s. 5 (1), par. (d). Those words were not in the earlier Act.

INNS OF COURT OFFICERS' TRAINING CORPS.-Would you be good enough to allow me to make an announcement once again through your columns? Our war memorial at Berkhamsted, where the corps were stationed throughout the war, is being unveiled on Saturday, the 5th inst., at 4 p.m., by Lieut.-General Sir E. C. Bethune, K.C.B., C.V.O. It is hoped that as many of the old members as possible will be present, and that they will on this occasion turn up in uniform, though this is, of course, not essential. Motor char-àbancs are running from these headquarters to Berkhamsted at 2 p.m. on that date and returning to London by 7 p.m. The return fare is 10s. All those wishing to travel in this way should apply to me at the above address, with remittance, before Thursday, the 3rd prox. PAYMENT OF INTEREST IN LIEU OF NOTICE ON REDEMPTION OF MORTGAGE.-A mortgagor in tendering six months' interest in lieu of notice on redeeming a mortgage claimed that he was both legally obliged and legally entitled to deduct income tax from such six months' interest. The mortgagee objected to allow any deduction for income tax, and insisted on the six months' interest being paid in full. The Board of Inland Revenue were asked for an expression of their opinion generally on the point, and we inclose copy of their reply received the 2nd inst. We do not know whether the matter is of interest to you or your readers, but, if so, you can, of course, publish this letter with its inclosure.

OBITUARY

Mr. FREDERICK RICHARD ROBERTS, solicitor, of the firm of Messrs. Roberts and Evans, Aberystwith, died on the 23rd ult., aged sixtytwo. Mr. Roberts was clerk of the peace for Cardiganshire, and was a member of the Law Society.

Mr. EDWIN SINGLETON, solicitor, of Luton, died on the 17th ult.,. aged seventy-five. Mr. Singleton was articled to his father, the late Mr. J. Singleton, of York, and was admitted in 1868.

Mr. WILLIAM BURBEROW SMITH, solicitor, of Nottingham, died on the 25th ult., aged seventy-five. He was admitted in 1882, and afterwards went from London to join the late Mr. S. Brittle as managing clerk. Later he entered the office of the late Mr. John Watson, the first Official Receiver for Nottingham, taking charge of the bankruptcy business, and upon the death of that gentleman he started his own business.

Sir JAMES PRENDERGAST, barrister-at-law, Chief Justice of New Zealand from 1875 to 1899, has died at Wellington, aged ninetythree. Sir James was educated at Queens' College, Cambridge, and was called by the Middle Temple in 1885. He was called to the New Zealand Bar in 1862.

Messrs. Knocker, Knocker, and Co., of Sevenoaks, have taken into partnership Capt. B. Foskett, M.C. (formerly of Newcastle-onTyne). The practice will be carried on under the style of Knocker, Knocker, and Foskett.

Mr. G. A. Atkinson, assistant solicitor to the Liverpool Corporation, left estate of the gross value of £12,754.

Mr. Joseph Hamilton Glover, solicitor, of Liverpool, who died recently, left estate of the gross value of £27,990.

ON Tuesday last Lord MOULTON died suddenly, and by his death both law and science have lost a man of great and singular ability. We think that it will be for his scientific attainments, particularly in connection with his appointment as Director-General of Explosive Supplies during the war, that he will be chiefly remembered, for the legal side of his life cannot be truly described as an unqualified success, save from a merely material point of view. He entirely failed to reach that position in the esteem of the Profession his great attainments deserved.

COMPOUND SETTLEMENTS

THE ordinary practitioner may be excused if he has a difficulty in determining whether or not, when acting for a vendor or purchaser of land on a sale under the Settled Land Acts, there is in existence a compound settlement; or, if there is one, whether it is necessary to have trustees thereof for the purpose of the said Acts, in order to enable the tenant for life to sell. The phrase " compound settlement" is not a term of art, and is not mentioned in the Settled Land Acts. Ex vi termini it would seem to apply to every case where the settlement consists of more than one instrument, but it does not follow, because there is a compound settlement, that it is necessary to appoint trustees thereof for the purpose of the said Acts. It is only necessary to do so where the tenant for life desires to override family charges created by an instrument prior in date to the instrument creating his life estate.

By way of making the point clear we give three instances of each kind-that is, of one in which it is necessary to appoint trustees of the compound settlement, and the other in which it is not necessary to do so. The following are instances of the former, namely: (1) Re Marquis of Ailesbury and Lord Third Sheet.

life estate was created by an indenture dated in 1885, and the property was subject to certain jointure rentcharges created under and by virtue of indentures of settlement dated respectively in 1796, 1826, and 1863, and it was held by Mr. Justice Stirling (as he then was) that the whole series of deeds constituted a "settlement" within the meaning of sect. 20 of the Settled Land Act 1882, and that accordingly the tenant for life had power to convey the estates free from the jointure rentcharges, but that trustees ought to be appointed of the compound settlement for the purposes of the Settled Land Acts. (2) In Re Phillimore's Estate (91 L. T. Rep. 256 ; (1904) 2 Ch. 460) the facts were shortly as follows: By deed dated the 3rd Aug. 1886 certain real and leasehold property was assured to trustees upon trust for such persons as P. should by deed appoint. By deed dated the 4th Aug. 1886 he appointed the property in trust for himself for life, and subject thereto to pay certain annuities to five persons, for their respective lives, and subject thereto in trust for P. absolutely. He died in Feb. 1887, having by will given his residuary estate, which included his interest in the property subject to the annuities, upon trusts which were, in effect, strict settlement trusts, under which the plaintiff was tenant for life and his infant son tenant in tail in remainder. It was held by Mr. Justice Farwell (as he then was) that the two deeds of 1886, and the will, formed a compound settlement; and that the plaintiff, as tenant for life under such settlement, could sell the properties discharged from the annuities. The summons in that case asked for the appointment of trustees of the settlement, and no doubt they were appointed, although the report does not say so. (3) Re Trafford's Settled Estates (112 L. T. Rep. 107; (1915) 1 Ch. 9). There a testator by his will dated in 1889 devised certain freehold estates to the use of his son E. S. T. for life, with remainder to the use of his first and other sons successively in tail male, with remainders over, and he charged his settled estates with certain annuities, some of which were still subsisting. The testator died in 1892, and the tenant for life died in 1912; and thereupon his eldest son S. T. became tenant in tail in possession. On the 8th April 1914 S. T. executed a disentailing assurance, which was duly enrolled, limiting the settled estates to his own use in fee simple. On the 17th April 1914 he executed a resettlement on his marriage of part of the estates originally settled by the will, to the use of himself for life, with remainders over. It was held by Mr. Justice Warrington (as he then was) that by reason of the subsistence of the annuities there was a compound settlement consisting of the will, the disentailing assurance, and the resettlement, and that trustees of such compound settlement ought to be appointed.

The following are instances of compound settlements where it was not necessary to appoint trustees thereof, though,
